DETAILED ACTION Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Claim Rejections - 35 USC § 112 The following is a quotation of 35 U.S.C. 112(b): (b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention. The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph: The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention. Claims 1-7 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention. Claim 1, line 3 recites “from bottom to top” and it is unclear which element has the bottom and the top. Suggestion: Replace “from bottom to top” with “from a bottom to a top of” the element having the bottom and top. Claim 6, line 2 recites “the top” of the connecting shaft, and there is no antecedent basis for it. Claim 7 recites “a foam pump” and it is unclear if it is the same element as “a foam pump” of claim 1, line 2. Suggestion: Replace “is a foam pump with a filler plug” with “has a filler plug”. The remaining claims are rejected for depending on claim 1. Allowable Subject Matter Claims 1-7 would be allowable if rewritten or amended to overcome the rejection(s) under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), 2nd paragraph, set forth in this Office action. The following is an examiner’s statement of reasons for allowance: The best reference, Zachar (US 2017/0042648 A1), does not include both an air inlet on a left side of a top of a foam pump and a liquid inlet on a right side of the top of the foam pump, as recited in claim 1, final 3 lines.
