Claim Rejections - 35 USC § 102
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention.
Claim(s) 1-2,4-6,8,9 is/are rejected under 35 U.S.C. 102a1 as being anticipated by DE 60123320 T2.
Regarding claim 1, as broadly claimed, DE ‘320 shows in figures 3-5:
A brake device comprising:
brake mechanism including a shaft 10 received in a brake chamber 22 (It should be noted that because of the arrangement of the braking means 14 and 16 in the brake release chamber [22] in an operating situation of the rotor ) capable of being filled with a liquid, the brake mechanism being configured to switch between a braking applied state, in which the brake mechanism restricts a rotational motion of the shaft 10 by generating a braking force, and a braking released state, in which the brake mechanism permits the rotational motion of the shaft 10 by not generating the braking force, wherein the brake chamber is filled with the liquid in the braking applied state, and the brake chamber is evacuated of the liquid in the braking released state (In this case, this circulates in the chamber 26 introduced fluid through the connecting line 38 . 38 ' or 38 '' into the brake release chamber 22 to pass through the pipe 24 to be evacuated).
Regarding claim 2, as broadly claimed, DE ‘320 shows a ‘volume changing mechanism’ (pump P, valves 50-70, Reservoir 56) configured to change a volume of the brake chamber 22 between a first volume, at which the brake chamber is filled with the liquid, and a second volume, at which the brake chamber is evacuated of the liquid.
Regarding claim 4 note DE ‘320 claims in claim 1 “.. System for braking a rotor ( 10 ) with respect to a stator ( 12 ), comprising first braking means ( 14 ), which are fixedly connected to the rotor, second brake means ( 16 ), which are firmly connected to the stator.
Therefore these limitations are considered to be met.
Regarding claim 5, as broadly claimed, the ‘common channel’ for supplying a pilot pressure could be the lines connecting to ports 24 and/or 28.
Regarding claim 6 as shown in figures 4 and 5 at least one of the parts (pump P, valves 50-70, Reservoir 56) of the volume changing mechanism are capable of being located lower than the brake chamber 22.
Regarding claims 8,9 as explained above, these limitations are met.
Allowable Subject Matter
Claims 3,7 objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims.
