DETAILED ACTION
Claim Rejections - 35 USC § 103
The following is a quotation of 35 U.S.C. 103 which forms the basis for all obviousness rejections set forth in this Office action:
A patent for a claimed invention may not be obtained, notwithstanding that the claimed invention is not identically disclosed as set forth in section 102, if the differences between the claimed invention and the prior art are such that the claimed invention as a whole would have been obvious before the effective filing date of the claimed invention to a person having ordinary skill in the art to which the claimed invention pertains. Patentability shall not be negated by the manner in which the invention was made.
Claim(s) 1-3 and 5-9 is/are rejected under 35 U.S.C. 103 as being unpatentable over in Jianbo (EP3753396A1) view of Yongxing (CN114303679).
Regarding claim 1 and 7, Jianbo discloses the invention substantially as claimed including a power tool body a motor (see Fig. 11); and a transmission gear set (see Fig. 10), connected with the motor in a transmission and comprising: a driving gear 232, fixed to an output shaft 73 of the motor; and a driven gear 233, meshing with the driving gear; wherein, a speed of the motor is from 5000rpm to 11000rpm, a diameter of the motor is from 20mm to 50mm, and a reduction ratio of the driving gear to the driven gear is from 2 to 7 (see Table 1). Jianbo doesn’t show a volume of the motor is from 600mm3 to 2200mm3, a weight of the motor is from 90g to 260g. However, Yongxing teaches the use of a volume of the motor is from 600mm3 to 2200mm3, a weight of the motor is from 90g to 260g, a volume of the motor is from 600mm3 to 2200mm3, a weight of the motor is from 90g to 260g for the purpose of having a small in size, light in weight and long in endurance time. It would have been obvious to one having ordinary skill in the art at the time the invention was made to have modified the device of Jianbo by providing the above limitation as taught by Yongxing in order to obtain a device that have a small in size, light in weight and long in endurance time.
Also, Jianbo teaches:
Claim 2; wherein the motor is an outer rotor motor, a rotating speed of the motor is 10000rpm, and the diameter of the motor is from 35mm to 40mm (see Table 1).
Claim 3; wherein the reduction ratio of the driving gear and the driven gear is 5 (see Table 1).
Claim 5; an eccentric block 2331, fixed on the driven gear 233, a center of the eccentric block being misaligned with a center of the driven gear (see Fig. 10), and the eccentric block being connected with a working assembly 30 of a power tool in a transmission (see Fig. 10); and a crank connecting rod 236, a first end of the crank connecting rod being rotatably connected with the eccentric block, and a second end of the crank connecting rod being rotatably connected with the working assembly of the power tool, and being configured to drive a blade 30 of the power tool to reciprocate.
Claim 6; wherein at least two eccentric blocks 2331 are arranged on the driven gear 233, which are respectively located on two sides of the driven gear, and arranged symmetrically along the center of the driven gear.
Claim 8; a housing 20, hollowed out in a middle and provided with a handle 11; a transmission gearbox 23, arranged at a bottom of the housing and configured to mount the transmission gear set; a working assembly 30, connected with the transmission gear set in a transmission; and a control component (PCB board assembly 50), mounted in the housing and configured to control a start and stop of the motor.
Claim 9; an upper blade 31, partially extending into the transmission gearbox and rotatably connected with a crank connecting rod, and the upper blade located outside the transmission gearbox being provided with a saw tooth 31; a lower blade 31, partially protruding into the transmission gearbox and rotatably connected with the crank connecting rod, and provided with a same structure as the upper blade, and a saw tooth on the lower blade and the saw tooth on the upper blade being misaligned; and a supporting arm 32, partially extending into the gear transmission box, and fixedly connected with the upper blade and the lower blade by bolts.
Allowable Subject Matter
Claims 4 and 10-19 are objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims.
