Election/Restrictions
Applicants’ election of Group I with traverse, specifically the species of claim 3, and identifies claim 1-8 as compassing the elected species in the reply filed on 18/17/2025 is acknowledged.
Claim Rejections - 35 USC § 112
The following is a quotation of 35 U.S.C. 112(b):
(b) CONCLUSION. The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention.
The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph:
The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention.
Claim 1 is rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention. Claim 1 recites “the eye fixation portion comprises a patient specific portion” in lines 11-12. However, the specification teaches “The patient-specific portion is for example a part or a section of the coupling portion and/or the eye fixation portion or the entire coupling portion and/or the entire eye fixation portion. Further, the patient-specific portion may form the entire ophthalmological patient interface.” The scope of the recited patient-specific portion cannot be determined from the claim language or the specification and therefore renders the claim indefinite.
Allowable Subject Matter
Claim 3 is objected to as being dependent upon a rejected base claim but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims.
