Claim Rejections - 35 USC § 102(a)(1)
6. The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention.
Claim(s) 1-9 is/are rejected under 35 U.S.C. 102(a)(1) as being anticipated by WO 2013/025999 A1.
The claimed invention relates to a carbon dioxide adsorbent, which is capable of adsorbing and desorbing carbon dioxide, and comprises one or more cyclic disulfide structures (as recited in instant claim 1).
WO 2013/025999 A1 discloses disulfide as a precursor for capture (adsorb) and release (desorb) of carbon dioxide (see Abstract).
Regarding claims 1, 2, & 5, the reference teaches the claimed carbon dioxide adsorbent comprises cyclic disulfide (see Abstract; p. 25, claim 4). The reference further discloses Fig. 8 shows a cyclic voltammogram illustrating the change in electrochemistry for bis(4-aminophenyl)disulfide without CO2 and with CO2 (see [0057]).
Regarding claims 3 & 9, the disclosed adsorbent is able to perform oxidation-reduction reaction by electrochemical (see p. 20, [0053]-[0054]). The disulfide disclosed would also exhibit an oxidation-reduction potential higher than that of oxygen as well because it is the same adsorbent.
Regarding claim 4, the disulfide precursor has a structure where each R is independently a functional group, such as an alkyl, aryl, heteroalkyl, or heteroaryl functional group, attached to one sulfur of a disulfide (see p. 8, [0029]).
Regarding claims 6-8, it is considered the disclosed disulfide has a porous metal-organic framework, a covalent-organic framework, and a polymer including a molecule containing the cyclic disulfide structure as a unit structure in view of the same disulfide disclosed and claimed.
Claims 1-9 are unpatentable as being anticipated by WO 2013/025999 A1.
