DETAILED ACTION Notice of Pre-AIA or AIA Status 1. The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Election/Restrictions 2. Applicant’s election without traverse of claims 7, 10-13, 16, and 20-24 in the reply filed on 4/8/2026 is acknowledged. Claims 1-4, 8-9, and 17-19 are withdrawn from further consideration pursuant to 37 CFR 1.142(b) as being drawn to a nonelected invention, there being no allowable generic or linking claim. Election was made without traverse in the reply filed on 4/8/2026. Claim Rejections - 35 USC § 112 3. The following is a quotation of 35 U.S.C. 112(b): (b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention. The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph: The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention. 4. Claims 7, 10-13, 16, and 20-24 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention. Regarding claim 20, the phrase “defined in Table 1” in line 23 is indefinite because “Table 1” is not defined in the claim and reference to a table in a claim is only permitted in exceptional circumstances where there is no practical way to define the inventions in words (see MPEP 2173.05(s)). Furthermore, the terms “low”, “moderate”, and “high” in claims 20 and 21 are relative terms which renders the claim indefinite. The terms “low”, “moderate”, and “high” are not defined by the claim, the specification does not provide a standard for ascertaining the requisite degree, and one of ordinary skill in the art would not be reasonably apprised of the scope of the invention. Dependent claims 7, 10-13 and 22-24 are rejected for at least the reasons above by virtue of their claim dependency. Conclusion 5.
