DETAILED ACTION
This is a non-final First Office Action on the Merits in application 18/523,753, filed 11/29/2023.
Claims 1-23 are pending and examined.
Drawings
The drawings are objected to under 37 CFR 1.83(a) because they fail to show line 6-6 in Fig. 1 as described in the specification(see para. [0011], specifically Fig. 6 discussion), and line 10-10 in Fig. 1 as described in the specification(see para. [0011], specifically Fig. 10 discussion). Any structural detail that is essential for a proper understanding of the disclosed invention should be shown in the drawing. MPEP § 608.02(d). Corrected drawing sheets in compliance with 37 CFR 1.121(d) are required in reply to the Office action to avoid abandonment of the application. Any amended replacement drawing sheet should include all of the figures appearing on the immediate prior version of the sheet, even if only one figure is being amended. The figure or figure number of an amended drawing should not be labeled as “amended.” If a drawing figure is to be canceled, the appropriate figure must be removed from the replacement sheet, and where necessary, the remaining figures must be renumbered and appropriate changes made to the brief description of the several views of the drawings for consistency. Additional replacement sheets may be necessary to show the renumbering of the remaining figures. Each drawing sheet submitted after the filing date of an application must be labeled in the top margin as either “Replacement Sheet” or “New Sheet” pursuant to 37 CFR 1.121(d). If the changes are not accepted by the examiner, the applicant will be notified and informed of any required corrective action in the next Office action. The objection to the drawings will not be held in abeyance.
The drawings are objected to as failing to comply with 37 CFR 1.84(p)(5) because they do not include the following reference sign(s) mentioned in the description: 104a, 104b(see paras. [0081], [0085], [0086], and [0089]). Corrected drawing sheets in compliance with 37 CFR 1.121(d) are required in reply to the Office action to avoid abandonment of the application. Claim Objections
Claim 1 is objected to because of the following informalities: in line 19, “second tube assembly” should be “the second tube assembly”. Appropriate correction is required.
Claim Rejections - 35 USC § 112
The following is a quotation of 35 U.S.C. 112(b):
(b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention.
The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph:
The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention.
Claims 1-22 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention.
In claim 1, it is not clear how the first tube assembly is spaced from the first and second rollers in a second axis when the first and second rollers are spaced from one another and each spaced from the tube assembly(see Fig. 12), with the rollers not spaced in a single axis. Therefore, the metes and bounds of the claims are unclear as to how the rollers and tube motor assembly is interrelated.
In claim 17, “a first sensor assembly” is not clear if referring to the “a first sensor assembly” in claim 1 or to an additional assembly of the claim. By changing the phrase to “the first sensor assembly”.
In claim 21, “the angular interval” has no antecedent basis.
Claim 21 rejected under 35 U.S.C. 112(d) or pre-AIA 35 U.S.C. 112, 4th paragraph, as being of improper dependent form for failing to further limit the subject matter of the claim upon which it depends, or for failing to include all the limitations of the claim upon which it depends. Claim 21 depends from itself and should be amended to depend from claim 19. Applicant may cancel the claim(s), amend the claim(s) to place the claim(s) in proper dependent form, rewrite the claim(s) in independent form, or present a sufficient showing that the dependent claim(s) complies with the statutory requirements.
Allowable Subject Matter
Claims 1-22 would be allowable if rewritten or amended to overcome the rejection(s) under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), 2nd paragraph, set forth in this Office action.
Claim 23 is allowed.
No prior art of record appears to show a wall system having multiple tube assemblies each with a motor, a collar with sensor targets, and sensor assembly proximate the collar, and a control unit correcting a differential in rotational travel, as in claim 1, or a method of correcting a differential in rotational travel in a wall system with first and second tube assemblies, as in claim 23, nor any motivation to do so.
