Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Claim Rejections - 35 USC § 112 The following is a quotation of 35 U.S.C. 112(b): (b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention. The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph: The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention. Claims 1-10 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention. With respect to claim 1, in line 6, the phrase “determining, based upon the proposed structure and the LFE the proposed structure determines;” appears to be incomplete thus rendering the claim indefinite. For examining purposes, it is assumed that the step intended to be claimed is -determining the LFE associated with the proposed structure based on the building design. Allowable Subject Matter Claims 1-10 would be allowable if rewritten or amended to overcome the rejection(s) under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), 2nd paragraph, set forth in this Office action. The following is an examiner’s statement of reasons for allowance: The prior art of record does not teach or suggest a method for elevating the lowest floor elevation (LFE) of a proposed structure to be built on an existing grade to a height at or above the base flood elevation (BFE) comprising the steps of: determining the BFE from the Flood Insurance Rate Map based on the site location, determining the LFE based on the building design, determining the existing grade beneath the LFE, find the difference between the BFE and the existing grade and constructing a form having a height that equals the difference, and pouring permeable lightweight cellular concrete to fill the form and form a slab having a depth at the LFE equal to or exceeding the height of the form. Note that Applicant notes in the specification that FEMA defines the BFE as the computed elevation to which the flood is anticipated to rise during a base flood (also referred to as the 1 percent annual chance flood). There is no reasoning independent of hindsight that would have led one of ordinary skill in the art to modify the prior art to obtain Applicant’s invention.
