Notice of Pre-AIA or AIA Status
The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA ) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status.
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(2) the claimed invention was described in a patent issued under section 151, or in an application for patent published or deemed published under section 122(b), in which the patent or application, as the case may be, names another inventor and was effectively filed before the effective filing date of the claimed invention.
Claim(s) 1-8 is/are rejected under 35 U.S.C. 102(a)(2) as being clearly anticipated by Achard et al (US 2022/0219798; cited by Applicant). With respect to claims 1, 8, Achard et al, disclose the claimed marine propulsion device 110 with an electric motor 124, a housing that houses the electric motor 116, 154, a coolant circulation passage (paragraph 0075; 514, 542, 544) through which a coolant flows for cooling the electric motor 124, the coolant circulation passage including a cooling passage 542, 544 disposed through the electric motor and a heat exchange passage 514 connected to the coolant passage and disposed through the housing and a pump 516 configured to circulate the coolant in the coolant circulation passage. Note also propeller shaft (paragraph 0012) and propeller (paragraph 0012) in a lower case housing with cooling including heat exchanger 514 (note in particular Figure 16). With respect to claims 2-6, note Achard et al, Figure 16). Note also drive shat 420, cowl 154. With respect to claim 7, note Achard et al, motor control unit in the form of an inverter 421 integrated into a common housing with the motor with cooling passages 542, 544 disposed through the motor control unit (Figure 15; paragraph 0075).
The prior art made of record and not relied upon is considered pertinent to applicant's disclosure. Hamada et al (US 2018/0306306) shows a cooling system for an outboard motor.
