Office Action

§102 §103
Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . ELECTION RECEIVED Applicant’s election of Figures 1-5 (claims 1-11) without traverse is acknowledged. 102/103 USC REJECTION Claim(s) 1,3,4 is/are rejected under 35 U.S.C. 102(a1) as anticipated by or, in the alternative, under 35 U.S.C. 103 as obvious over Cadoret et al CA 296121. As to claims 1,3,4, Cordoret teaches (Figure 9) a calibration mark apparatus comprising: a support 20 having at least one wall and at least one calibration pattern (checkerboard pattern) on the least one wall; and at least one attachment portion (grip) extending from the at least one wall. The grips are as much an attachment as claimed, or one of ordinary skill would recognize that such grip is attached to the support which supports the calibration pattern. PRIOR ART CITED, NOT APPLIED The prior art made of record and not relied upon is considered pertinent to applicant's disclosure. Ferrera et al CN 109844452 teach (Figure 3A) support 18 with calibration pattern, such with attachment leg. Chen et al CN 110230979 teach pyramid type target. Qin et al CN 118628579 teach (Figure 1) triangular prism 3 structure with pattern 4. Feldmann et al DE 102016008689 teach triangular prism with patterns. OBJECTED TO CLAIMS Claims 2,5-11 are objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims.
