DETAILED ACTION 1. The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Applicant’s election without traverse of Group I in the reply filed on 12/16/2025 is acknowledged. Claims 8 and 13-20 are withdrawn from further consideration pursuant to 37 CFR 1.142(b) as being drawn to a nonelected Group and Species, there being no allowable generic or linking claim. Election was made without traverse in the reply filed on 12/16/2025. INFORMATION DISCLOSURE STATEMENT 2. Information Disclosure Statements filed 4/23/2024 and 3/27/2025 are acknowledged. Claim Rejections- 35 USC § 112 3. The following is a quotation of 35 U.S.C. 112(b): (b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention. The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph: The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention. Claim 12 is rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention. Claim 12 recites MCM-41 and MCM-48 “type” and further recites (having size ranging from about 8 nm to about 1000 nm) and recites SBA-15 type (having size ranging from about 8nm to about 1000 nm), colloidal silica (having size ranging from about 8 nm to about 1000 nm), KCC-1 (nanofibrous silica having size ranging from about 10 nm to about 1000 nm), mesoporous titanium (having size ranging from about 8 nm to about 1000 nm) and colloidal titania (having size ranging from about 8nm to about 1000 nm) and the parenthesis renders the claim indefinite because it is not clear if the limitations are part of the claim or not. Furthermore, the recitation of the term “type” renders the claim indefinite because it is unclear what would need to be such that it would make it the same type. It is suggested to remove the parenthesis and the term type. Claim Rejections- 35 USC § 102 4. In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA ) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status. The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action: A person shall be entitled to a patent unless – (a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention. Claims 1-2 and 9-10 rejected under 35 U.S.C. 102(a)(1) as being anticipated by Amir et al. (US 20170245492) Amir et al. (US 20170245492) (hereinafter Amir et al.) disclose nanoparticles (para 0020-0022) containing a pH dependent group and an agrochemical combination (paras 0098-0099 0148 claim 48-50, 66). Small molecular drugs are envisioned (claim 67). The delivery system comprises hydrophilic polyethylene glycol (PEG) which are known as biocompatible. Claim Rejections- 35 USC § 103 5. In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA ) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status. The following is a quotation of 35 U.S.C. 103 which forms the basis for all obviousness rejections set forth in this Office action: A patent for a claimed invention may not be obtained, notwithstanding that the claimed invention is not identically disclosed as set forth in section 102, if the differences between the claimed invention and the prior art are such that the claimed invention as a whole would have been obvious before the effective filing date of the claimed invention to a person having ordinary skill in the art to which the claimed invention pertains. Patentability shall not be negated by the manner in which the invention was made. The factual inquiries for establishing a background for determining obviousness under 35 U.S.C. 103 are summarized as follows: 1. Determining the scope and contents of the prior art. 2. Ascertaining the differences between the prior art and the claims at issue. 3. Resolving the level of ordinary skill in the pertinent art. 4. Considering objective evidence present in the application indicating obviousness or nonobviousness. This application currently names joint inventors. In considering patentability of the claims the examiner presumes that the subject matter of the various claims was commonly owned as of the effective filing date of the claimed invention(s) absent any evidence to the contrary. Applicant is advised of the obligation under 37 CFR 1.56 to point out the inventor and effective filing dates of each claim that was not commonly owned as of the effective filing date of the later invention in order for the examiner to consider the applicability of 35 U.S.C. 102(b)(2)(C) for any potential 35 U.S.C. 102(a)(2) prior art against the later invention. Claims 1, 3-7 and 11-12 are rejected under 35 U.S.C. 103 as being unpatentable over Amir et al. (US 20170245492) in view of Shen et al. (US 20110244002). Amir et al. has been discussed supra in the 102. Amir et al. disclose inclusion of rafoxanide and copper acetate (Cu(II)) as active ingredients (para 0145 and 0148). Amir et al. does not teach silica nanoparticle or mesoporous silica. Claim 7 recites how the nanoparticle is prepared which is a product by process claim. “[E]ven though product-by-process claims are limited by and defined by the process, determination of patentability is based on the product itself. The patentability of a product does not depend on its method of production. If the product in the product-by-process claim is the same as or obvious from a product of the prior art, the claim is unpatentable even though the prior product was made by a different process.” In re Thorpe. Shen et al. (US 20110244002) (hereinafter Shen et al.) disclose mesoporous materials which help stabilize the amorphous from of the active ingredient and the mesoporous channels exhibit good stability during extended storage under stress test conditions and possesses significantly enhanced dissolution rates (abstract). The mesoporous material includes those such as MS41 family and silica materials (para 0009 and claim 21). It would have been prima facie obvious to one of ordinary skill in the art before the effective filing date of the instant invention to include mesoporous silica nanoparticles in the composition of Amir et al. One would have been motivated to do so in order to stabilize poorly soluble active ingredients (e.g., rafoxanide). DOUBLE PATENTING 6. The nonstatutory double patenting rejection is based on a judicially created doctrine grounded in public policy (a policy reflected in the statute) so as to prevent the unjustified or improper timewise extension of the “right to exclude” granted by a patent and to prevent possible harassment by multiple assignees. A nonstatutory double patenting rejection is appropriate where the conflicting claims are not identical, but at least one examined application claim is not patentably distinct from the reference claim(s) because the examined application claim is either anticipated by, or would have been obvious over, the reference claim(s). See, e.g., In re Berg, 140 F.3d 1428, 46 USPQ2d 1226 (Fed. Cir. 1998); In re Goodman, 11 F.3d 1046, 29 USPQ2d 2010 (Fed. Cir. 1993); In re Longi, 759 F.2d 887, 225 USPQ 645 (Fed. Cir. 1985); In re Van Ornum, 686 F.2d 937, 214 USPQ 761 (CCPA 1982); In re Vogel, 422 F.2d 438, 164 USPQ 619 (CCPA 1970); In re Thorington, 418 F.2d 528, 163 USPQ 644 (CCPA 1969). A timely filed terminal disclaimer in compliance with 37 CFR 1.321(c) or 1.321(d) may be used to overcome an actual or provisional rejection based on nonstatutory double patenting provided the reference application or patent either is shown to be commonly owned with the examined application, or claims an invention made as a result of activities undertaken within the scope of a joint research agreement. See MPEP § 717.02 for applications subject to examination under the first inventor to file provisions of the AIA as explained in MPEP § 2159. See MPEP § 2146 et seq. for applications not subject to examination under the first inventor to file provisions of the AIA . A terminal disclaimer must be signed in compliance with 37 CFR 1.321(b). The filing of a terminal disclaimer by itself is not a complete reply to a nonstatutory double patenting (NSDP) rejection. A complete reply requires that the terminal disclaimer be accompanied by a reply requesting reconsideration of the prior Office action. Even where the NSDP rejection is provisional the reply must be complete. See MPEP § 804, subsection I.B.1. For a reply to a non-final Office action, see 37 CFR 1.111(a). For a reply to final Office action, see 37 CFR 1.113(c). A request for reconsideration while not provided for in 37 CFR 1.113(c) may be filed after final for consideration. Claims 1-12 are rejected on the ground of nonstatutory double patenting as being unpatentable over claims 1-7 of U.S. Patent No. 12589166. Although the claims at issue are not identical, they are not patentably distinct from each other because both are drawn to nanoparticles functionalized with at least on pH responsive moiety with at least one cargo the differences being the instant claims recite swelling of the at least one pH responsive moiety allows for release of at least two cargos however, both encompass the same group DAMO which achieves this.
