DETAILED ACTION Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA. Claim Rejections - 35 USC § 112 The following is a quotation of the first paragraph of 35 U.S.C. 112(a): (a) IN GENERAL.—The specification shall contain a written description of the invention, and of the manner and process of making and using it, in such full, clear, concise, and exact terms as to enable any person skilled in the art to which it pertains, or with which it is most nearly connected, to make and use the same, and shall set forth the best mode contemplated by the inventor or joint inventor of carrying out the invention. The following is a quotation of the first paragraph of pre-AIA 35 U.S.C. 112: The specification shall contain a written description of the invention, and of the manner and process of making and using it, in such full, clear, concise, and exact terms as to enable any person skilled in the art to which it pertains, or with which it is most nearly connected, to make and use the same, and shall set forth the best mode contemplated by the inventor of carrying out his invention. Claim s 1 -20 are rejected under 35 U.S.C. 112(a) or 35 U.S.C. 112 (pre-AIA), first paragraph, as failing to comply with the enablement requirement. The claim(s) contains subject matter which was not described in the specification in such a way as to enable one skilled in the art to which it pertains, or with which it is most nearly connected, to make and/or use the invention. Regarding to claims 1, 8, 15: In the identification step: Regarding to the comparison of the first set of data and the second set of data to identify the first impulse response and the second impulse response, the Specification , in the detail description section, does not clearly describe how such comparison takes place and how either the first impulse response or the second impulse response is identified accordingly to the comparison . Furthermore, the Specification does not explain the step of simulating a first set of position data and what the simulated first set of position data is for . In addition, it is unclear on how the limitation “ simulating a first set of position data associated with the surface end of the rod ” links to the other limitations , and it is also unclear if “the position data” (in “generate, based on a first model of the pump system and the position data”) is the first set of position data after simulating. In the step of generating the second model to operate the pump system: The Specification is unclear on how the second model is generated from the measuring and the estimating as claimed. The claim s are also unclear on how the second model operates the pump system, or how the data from the measurement and from the estimations, such as the measured second set of position data and the measured set of force data and the estimated force data and the estimated position data, are used to operate the pump system. The claim s , in fact, recite the steps of measuring and estimating without further defining how the second model is generated from such measuring and estimating. In addition, i t is unclear on how the limitation “ measuring, during operation of the pump system, a second set of position data and a set of force data associated with the rod ” links to the other limitations. As a result, without detailly teaching the claimed invention in the Specification, one of ordinary skill in the art would not know how to use/make the invention. And with missing the connection between the limitations, the scope of the claimed invention cannot be determined. Claims 2-7, 9-14, and 16-20 are rejected because they depend on claim 1, 8, or 15.
