Office Action

§102
DETAILED ACTION Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . This Office Action is in response to the Applicants' response to restriction requirement received on 07/22/2026. Applicant’s election without traverse of claims 1-17 is acknowledged. Claim Status Claims 1-17, 21 are currently presenting for examination. Claims 18-20 are withdrawn. Claim 21 is newly added. This action has been made NON-FINAL. Priority Acknowledgment is made of applicant's claim for foreign priority based on an application (TW112118812) filed in Taiwan on 05/19/2023. It is noted, however, that applicant has not filed a certified copy of the foreign application as required by 37 CFR 1.55. To satisfy the requirement of 37 CFR 1.55 for a certified copy of the foreign application, applicant may simply identify the parent nonprovisional application or patent for which reissue is sought containing the certified copy. Claim Rejections - 35 USC § 102 The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action: A person shall be entitled to a patent unless – (a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale or otherwise available to the public before the effective filing date of the claimed invention. (a)(2) the claimed invention was described in a patent issued under section 151, or in an application for patent published or deemed published under section 122(b), in which the patent or application, as the case may be, names another inventor and was effectively filed before the effective filing date of the claimed invention. Claim 1 is rejected under 35 U.S.C. 102(a)(1) as being anticipated by Zhang, CN 106385661 A. For claim 1. Zhang teaches: A device for transmitting a pairing request information to a host, comprising: a circuit, having: a memory having a field which includes a field status; a transceiver; and a processor electrically connected to the memory and the transceiver; (Zhang, translation, paragraph 154-163, pairing request terminal includes communication module, storage module which stores identification number, and control module; paragraph 173, processor executes instructions stored in memory to perform method; paragraph 12-13, identification number is saved in memory; the status of whether or not the identification number is in memory is known since paragraph 12-13 mentions, “in the process of sending a pairing request, the requesting terminal sends a pairing request when the identification number does not exist in the memory”) a switch; and a power source electrically connected to the circuit and the switch, (Zhang, translation, paragraph 53, terminal includes built-in battery or external power supply; implicit that there is a switch to power on since paragraph 40 mentions “It should be noted that the automatic pairing request can be sent automatically by the requesting terminal after the requesting terminal is turned on”) wherein when the power source is turned on through the switch to provide a power to the processor of the circuit, the processor is configured to execute a procedure of determining whether to automatically transmit the pairing request information based on the field status of the field. (Zhang, translation, paragraph 12-13, “In addition, in the process of saving the identification number, the requesting terminal saves the identification number in the memory; in the process of sending a pairing request, the requesting terminal sends a pairing request when the identification number does not exist in the memory. By checking if an identification number exists in the database, it can be determined whether a pairing request needs to be sent for pairing.”; paragraph 40, “It should be noted that the automatic pairing request can be sent automatically by the requesting terminal after the requesting terminal is turned on”; paragraph 53, “if the requesting terminal stores the responding terminal's identification number in flash memory, and then the requesting terminal is powered off, the responding terminal identification number stored in flash memory will still exist, and the requesting terminal will enter a sleep state. When the requesting terminal is powered back on, it will directly communicate with the previously paired responding terminal without needing to automatically pair again.”) Allowable Subject Matter Claims 2-17, 21 are objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims.
