Office Action

§112 §DP
Notice of Pre-AIA or AIA Status The present application is being examined under the pre-AIA first to invent provisions. Applicant's response to the previous Office action, dated November 17, 2025, has been received. By way of this submission, Applicant has amended claims 1 and 15, and cancelled claims 6-7, 44, 53, 56-58 and 62. Claims 1, 10, 13-15, 27 and 40-42 are pending in the application and under examination before the Office. The rejections of record can be found in the previous Office action, dated June 18, 2025. Information Disclosure Statement The information disclosure statement (IDS) submitted on November 17, 2025 was filed after the mailing date of the first Office action on the merits on June 18, 2025. The submission is in compliance with the provisions of 37 CFR 1.97. Accordingly, the information disclosure statement is being considered by the examiner. Specification The specification was previously objected to due to a defect in the sequence listing. Applicant argues that the "000" entries for SEQ ID NOs: 4, 34-37, and 42 in the submitted Sequence Listing XML are not invalid sequences, but the required placeholders for intentionally skipped sequences in the instant application. Applicant's arguments are persuasive, and this objection is hereby withdrawn. Claim Rejections - 35 USC § 112 The following is a quotation of the first paragraph of 35 U.S.C. 112(a): (a) IN GENERAL.—The specification shall contain a written description of the invention, and of the manner and process of making and using it, in such full, clear, concise, and exact terms as to enable any person skilled in the art to which it pertains, or with which it is most nearly connected, to make and use the same, and shall set forth the best mode contemplated by the inventor or joint inventor of carrying out the invention. The following is a quotation of the first paragraph of pre-AIA 35 U.S.C. 112: The specification shall contain a written description of the invention, and of the manner and process of making and using it, in such full, clear, concise, and exact terms as to enable any person skilled in the art to which it pertains, or with which it is most nearly connected, to make and use the same, and shall set forth the best mode contemplated by the inventor of carrying out his invention. Claims 1, 10, 13-15, 27 and 40-42 are rejected under 35 U.S.C. 112(a) or 35 U.S.C. 112 (pre-AIA ), first paragraph, as failing to comply with the written description requirement. The claim(s) contains subject matter which was not described in the specification in such a way as to reasonably convey to one skilled in the relevant art that the inventor or a joint inventor, or for applications subject to pre-AIA 35 U.S.C. 112, the inventor(s), at the time the application was filed, had possession of the claimed invention. Applicant argues that the recited five complementarity determining regions (CDRs) recited in amended claim 1 are sufficient to define the claimed antibody, as allegedly only the five enumerated CDRs are required to bind the cognate antigen. Applicant's arguments have been considered fully but are not found persuasive. To satisfy the written description requirement, the specification must describe the claimed invention in sufficient detail that one skilled in the art can reasonably conclude that the inventor had possession of the claimed invention. Vas-Cath, Inc. v. Mahurkar, 935 F.2d 1555, 1562-63, 19 USPQ2d 1111 (Fed. Cir. 1991). An adequate written description must contain enough information about the actual makeup of the claimed products — "a precise definition, such as structure, formula, chemic name, physical properties of other properties, of species falling with the genus sufficient to distinguish the gene from other materials", which may be present in "functional terminology when the art has established a correlation between structure and function". Amgen Inc. v. Sanofi, 124 USPQ2d 1354 (Fed. Cir. 2017). The claims as amended recite an antibody with only five CDRs, leaving the light chain CDR2 undefined. Under the broadest reasonable interpretation of the claim, this CDR can be any sequence. Not every sequence used in the light chain CDR2 will result in a functional antibody that binds KIT. Applicant has not disclosed a sufficient genus of antibodies with the claimed features to demonstrate possession of the genus. As stated previously, Wu et al. (J. Mol. Biol. (1999) 294, 151-162, cited previously) states that it is difficult to predict which framework residues serve a critical role in maintaining affinity and specificity due in part to the large conformational change in antibodies that accompany antigen binding (page 152 left col.) but certain residues have been identified as important for maintaining conformation. Padlan et al. (PNAS 1989, 86:5938-5942, cited previously) describes the crystal structure of an antibody-lysozyme complex where all 6 CDRs contribute at least one residue to binding and one residue in the framework is also in contact with antigen. Lamminmaki et al. (JBC 2001, 276:36687-36694, cited previously) describes the crystal structure of an anti-estradiol antibody in complex with estradiol where, although CDR3 of VH plays a prominent roll, all CDRs in the light chain make direct contact with antigen (even CDR2 of VL, which is rarely directly involved in hapten binding). For this reason, Applicant was not in possession of the structural attributes of a representative number of species possessed by the members of the genus of an antibody binding to KIT broadly encompassed by the claimed invention. This rejection is therefore maintained. Claim 15 was previously rejected under 35 U.S.C. 112(a) or 35 U.S.C. 112 (pre-AIA ), first paragraph, as failing to comply with the written description requirement. Applicant's amendments to the claims have addressed this issue, and this rejection is hereby withdrawn. Double Patenting The nonstatutory double patenting rejection is based on a judicially created doctrine grounded in public policy (a policy reflected in the statute) so as to prevent the unjustified or improper timewise extension of the “right to exclude” granted by a patent and to prevent possible harassment by multiple assignees. A nonstatutory double patenting rejection is appropriate where the conflicting claims are not identical, but at least one examined application claim is not patentably distinct from the reference claim(s) because the examined application claim is either anticipated by, or would have been obvious over, the reference claim(s). See, e.g., In re Berg, 140 F.3d 1428, 46 USPQ2d 1226 (Fed. Cir. 1998); In re Goodman, 11 F.3d 1046, 29 USPQ2d 2010 (Fed. Cir. 1993); In re Longi, 759 F.2d 887, 225 USPQ 645 (Fed. Cir. 1985); In re Van Ornum, 686 F.2d 937, 214 USPQ 761 (CCPA 1982); In re Vogel, 422 F.2d 438, 164 USPQ 619 (CCPA 1970); In re Thorington, 418 F.2d 528, 163 USPQ 644 (CCPA 1969). A timely filed terminal disclaimer in compliance with 37 CFR 1.321(c) or 1.321(d) may be used to overcome an actual or provisional rejection based on nonstatutory double patenting provided the reference application or patent either is shown to be commonly owned with the examined application, or claims an invention made as a result of activities undertaken within the scope of a joint research agreement. See MPEP § 717.02 for applications subject to examination under the first inventor to file provisions of the AIA as explained in MPEP § 2159. See MPEP § 2146 et seq. for applications not subject to examination under the first inventor to file provisions of the AIA . A terminal disclaimer must be signed in compliance with 37 CFR 1.321(b). The filing of a terminal disclaimer by itself is not a complete reply to a nonstatutory double patenting (NSDP) rejection. A complete reply requires that the terminal disclaimer be accompanied by a reply requesting reconsideration of the prior Office action. Even where the NSDP rejection is provisional the reply must be complete. See MPEP § 804, subsection I.B.1. For a reply to a non-final Office action, see 37 CFR 1.111(a). For a reply to final Office action, see 37 CFR 1.113(c). A request for reconsideration while not provided for in 37 CFR 1.113(c) may be filed after final for consideration. Claims 1, 6-7, 10, 13-15, 27 and 40-42 are rejected on the ground of nonstatutory double patenting as being unpatentable over the following claims of the U.S. patents: Conflicting Conflicting patent claims 9,334,332 1, 7-9, 12, 15-23, 28, 33, 36-37, 58 9,540,443 1-2, 13-15, 27-29, 31, 41-43 9,605,081 6-7 Applicant has requested that these rejections be held in abeyance until the indication of allowable subject matter. As there is currently not allowable subject matter present, the above rejections are maintained. Conclusion No claim is allowed. THIS ACTION IS MADE FINAL. A shortened statutory period for reply to this final action is set to expire THREE MONTHS from the mailing date of this action.
