Office Action

§112 §Other
Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . DETAILED ACTION 1. Original claims 1-6 filed on 12/15/23 are acknowledged and are under consideration in this Office Action. 2. Priority Receipt is acknowledged of papers (foreign priority filed 12/24/22) submitted under 35 U.S.C. 119(a)-(d), which papers have been placed of record in the file. 3. Drawings The drawings filed on 12/15/23 are acknowledged. 4. Specification The specification has not been checked to the extent necessary to determine the presence of all possible minor errors. Applicant's cooperation is requested in correcting any errors of which applicant may become aware in the specification. 5. Claim Rejections - 35 USC § 112 (second paragraph) The following is a quotation of 35 U.S.C. 112(b): (b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention. The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph: The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention. Claims 4 & 6 are drawn to as follows: 4. The recombinant S. cerevisiae according to claim 1 3, wherein pY26 series vectors or pET series vectors are used as expression vectors. 6. A method for synthesizing 3,15,19-Trihydroxy-8(17),13-ent-labdadiene-16-oic acid, using the recombinant S. cerevisiae according to claim 1 or the whole-cell catalyst comprising the recombinant S. cerevisiae as a fermentation strain for fermentation to produce 3,15,19-Trihydroxy-8(17),13-ent-labdadiene-16-oic acid. Claim 4 recites the limitation " wherein pY26 series vectors or pET series vectors are used as expression vectors" in claim 13. There is insufficient antecedent basis for this limitation in the claim. There is no claim 13 (may be a typo); and further if it were to depend on claim 1 or 3 there is no antecedent basis of the limitation in the claim(s). Rewording/cancellation of the claim is suggested to overcome this rejection. Claim 6 recites the limitation “or the whole-cell catalyst comprising the recombinant S. cerevisiae as a fermentation strain for fermentation to produce 3,15,19-Trihydroxy-8(17),13-ent-labdadiene-16-oic acid” in claim 1. There is no antecedent basis of the limitation in the claim 1. Suggestion to split claim 6 into claims 6 & 7 as follows: 6. A method for synthesizing 3,15,19-Trihydroxy-8(17),13-ent-labdadiene-16-oic acid, using the recombinant S. cerevisiae of claim 1, comprising the recombinant S. cerevisiae as a fermentation strain for fermentation to produce 3,15,19-Trihydroxy-8(17),13-ent-labdadiene-16-oic acid. 7. A method for synthesizing 3,15,19-Trihydroxy-8(17),13-ent-labdadiene-16-oic acid, using the whole-cell catalyst of claim 5 comprising the recombinant S. cerevisiae as a fermentation strain for fermentation to produce 3,15,19-Trihydroxy-8(17),13-ent-labdadiene-16-oic acid. 6. claims 1-3 & 5 are allowed. 7. Any inquiry concerning this communication or earlier communications from the examiner should be directed to TEKCHAND SAIDHA whose telephone number is (571)272-0940. The examiner can normally be reached on M-F 8.00-5.30. Examiner interviews are available via telephone, in-person, and video conferencing using a USPTO supplied web-based collaboration tool.
