The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
Claim Rejections - 35 USC § 112
The following is a quotation of 35 U.S.C. 112(b):
(b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention.
Claims 1-20 are rejected under 35 U.S.C. 112(b), as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor, regards as the invention.
It is unclear what the difference is between the term “parts by mass” in lines 2-3 of claim 1, and the term “% by mass” in the following lines 6-7. If the terms are just different units, it is also unclear how the terms relate numerically in a conversion of units.
It is also unclear in the last two lines of claim 1, what is meant by the term “a blending ratio”. It is unclear how it relates to the term “% by mass” in the preceding lines 6-7; and how it relates to the term “parts by mass” in the preceding lines 2-3. If the terms are just different units, it is also unclear how the terms relate numerically in conversions of units.
Claims 2-20 depend on and contain all the subject matter of claim 1, but fail to provide any solutions to the indefinite issues described above.
