Office Action

§102
DETAILED ACTION Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Election/Restrictions Applicant’s election without traverse of Group I, claims 1-8 and 10-12, in the reply filed on 7/28/26 is acknowledged. Unelected claim 9 is withdrawn from consideration.1 Elected claims 1-8 and 10-12 will be examined as follows. Claim Rejections - 35 USC § 102 The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action: A person shall be entitled to a patent unless – (a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention. Claim 1 is rejected under 35 U.S.C. 102(a)(1) as being anticipated by Takahashi, et al. (US 2020/0355749, herein Takahashi).2 Regarding claim 1, Takahashi teaches an estimation device comprising: a determination unit configured to determine whether a shape change mode of an energy storage device is a first mode or a second mode (paragraph 0048, see also paragraphs 0052-0054 & 0082-0085); and an estimation unit configured to estimate a change in shape of the energy storage device in response to the shape change mode determined by the determination unit (paragraph 0051). Allowable Subject Matter Claims 2-8 and 10-12 are objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims.3 Conclusion Any inquiry concerning this communication or earlier communications from the examiner should be directed to MATTHEW MIKELS whose telephone number is (571)270-5470.
