Election/Restrictions
Applicant’s election without traverse of Group I, claims 1-8 and 10-12, in the reply filed on 7/28/26 is acknowledged. Unelected claim 9 is withdrawn from consideration.1 Elected claims 1-8 and 10-12 will be examined as follows.
Claim Rejections - 35 USC § 102
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention.
Claim 1 is rejected under 35 U.S.C. 102(a)(1) as being anticipated by Takahashi, et al. (US 2020/0355749, herein Takahashi).2 Regarding claim 1, Takahashi teaches an estimation device comprising: a determination unit configured to determine whether a shape change mode of an energy storage device is a first mode or a second mode (paragraph 0048, see also paragraphs 0052-0054 & 0082-0085); and an estimation unit configured to estimate a change in shape of the energy storage device in response to the shape change mode determined by the determination unit (paragraph 0051).
Allowable Subject Matter
Claims 2-8 and 10-12 are objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims.3
