Claim Rejections - 35 USC § 102
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention.
(a)(2) the claimed invention was described in a patent issued under section 151, or in an application for patent published or deemed published under section 122(b), in which the patent or application, as the case may be, names another inventor and was effectively filed before the effective filing date of the claimed invention.
Claim 32 is rejected under 35 U.S.C. 102(a)(1)/(a)(2) as being anticipated by Forbes et al. (WO 2005/0233739 A1).
Regarding claim 32, Forbes et al. discloses A user equipment (UE) (see mobile [0005]), comprising:
at least one transceiver;
at least one memory comprising instructions; and
one or more processors configured to execute the instruction to cause the UE to:
receive, from a base station (see ground station fig. 1) via the at least one transceiver (see controller [0016]), one or more communications associated with accessing a cell associated with the base station (see fig. 1, see ground station), wherein the one or more communications include a master information block (MIB) (see MIB [0019]); and
selectively access, via the at least one transceiver, the cell associated with the base
station based at least in part on a determination of whether the MIB includes an indication that
the cell is dedicated for air-to-ground communications (see [0019] The system state MIB 44 is then sent as the inform 20 via a transponded satellite link to the ground network management system 26 for analysis on a periodic basis.[0026] If, however, a "Fault" state indicator is present for a component 16 in the system state MIB 44, the ground network management system 26 establishes a continuous trans ponded satellite transmission link with the aircraft 12 at operation 114.).
Claim 31 is rejected under 35 U.S.C. 102(a)(2) as being anticipated by Ghanbarinejad et al. (US 2023/0362857 A1).
Regarding claim 31, Ghanbarinejad discloses a user equipment (UE), comprising:
at least one transceiver (see transceiver, abstract);
at least one memory comprising instructions; and
one or more processors configured to execute the instruction to cause the UE to:
receive, from a base station via the at least one transceiver (see base station, fig. 1a), one or more
communications associated with accessing a cell associated with the base station, wherein the
one or more communications include a physical broadcast channel (PBCH) communication (see PBCH [0224]); and
selectively access, via the at least one transceiver, the cell associated with the base
station based at least in part on a determination of whether a PBCH scrambling sequence
indicates that the cell is dedicated for air-to-ground communications (see [0220], “inter-satellite links (ISLs) in a multi-hop NTN” ).
Conclusion
Claim 1, 7, 9-11, 31, 33-38 allowed.
