DETAILED ACTION
Notice of Pre-AIA or AIA Status
The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
Continued Examination Under 37 CFR 1.114
A request for continued examination under 37 CFR 1.114, including the fee set forth in 37 CFR 1.17(e), was filed in this application after final rejection. Since this application is eligible for continued examination under 37 CFR 1.114, and the fee set forth in 37 CFR 1.17(e) has been timely paid, the finality of the previous Office action has been withdrawn pursuant to 37 CFR 1.114. Applicant's submission filed on 8/17/2026 has been entered.
Response to Arguments
Applicant’s arguments with respect to claim(s) 1-6, 8, 9, 21 and 25 have been considered but are moot because the new ground of rejection does not rely on any reference applied in the prior rejection of record for any teaching or matter specifically challenged in the argument.
Claim Rejections - 35 USC § 112
The following is a quotation of 35 U.S.C. 112(b):
(b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention.
The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph:
The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention.
Claims 1-6, 8, 9, 21, and 25 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention.
Claim 1 is rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being incomplete for omitting essential steps, such omission amounting to a gap between the steps. See MPEP § 2172.01. The omitted steps are: Claim 1 ends with the language “the receivers to be worken being selected by the user device”. The use of the future tense “to be woken” implies that the selection happens by the user device at some point after the method steps explicitly recited as being performed by the radio access node.
Claim 21 is rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being incomplete for omitting essential elements, such omission amounting to a gap between the elements. See MPEP § 2172.01. The omitted elements are: Claim 21 recites an apparatus for a radio access node configured for transmission to a user device, meaning the user device is not part of the claimed apparatus. The applicant is claiming an action of selection that is attributed to the user device and therefore the user device is essential to the invention but not covered as part of the scope of the claim.
Claim Rejections - 35 USC § 102
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention.
Claim(s) 1-6, 8, 9, and 21 is/are rejected under 35 U.S.C. 102(a)(1) as being anticipated by International Publication Number WO2020/076465 by Nam et al.
As to claim 1, Nam teaches a method for a radio access node configured for transmission to a user device over multiple links, the user device having a plurality of receivers, the method comprising: responsive to data being available for transmission to the user device (paragraph 61), determining which of the multiple links are possible links for transmission of the data (paragraphs 79 and 93); selecting a plurality of links of the possible links; and transmitting a wake-up signal to the user device (step 1110), the wake-up signal including a request to wake up a number of the plurality of receivers corresponding to the selected links (paragraph 63), the receivers to be woken being selected by the user device (paragraph 105).
As to claim 2, see paragraphs 32 and 61.
As to claim 3, see Figure 11.
As to claim 4, see Figure 11.
As to claim 5, see Figure 11.
As to claim 6, see Figure 9 and paragraphs 109 and 110.
As to claim 8, see Figure 11, the WUS can indicate which links should be woken.
As to claim 9, see paragraphs 63 and 105.
As to claim 21, it is rejected for the same reasoning as claim 1.
As to claim 25, see paragraph 105.
