Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Claims 1-15 are pending in this application. Response to Amendment Applicant’s amendment filed 03/16/2026 in response to the previous Office Action (12/31/2025) is acknowledged. Rejection of claims 1-9 under 35 U.S.C. 112(b) (items 5a-5b) have been obviated. The written description requirement rejection of claims 1-9 under 35 U.S.C. 112(a) has been maintained. Claim Rejections - 35 USC § 112 The following is a quotation of the first paragraph of 35 U.S.C. 112(a): (a) IN GENERAL.—The specification shall contain a written description of the invention, and of the manner and process of making and using it, in such full, clear, concise, and exact terms as to enable any person skilled in the art to which it pertains, or with which it is most nearly connected, to make and use the same, and shall set forth the best mode contemplated by the inventor or joint inventor of carrying out the invention. The following is a quotation of the first paragraph of pre-AIA 35 U.S.C. 112: The specification shall contain a written description of the invention, and of the manner and process of making and using it, in such full, clear, concise, and exact terms as to enable any person skilled in the art to which it pertains, or with which it is most nearly connected, to make and use the same, and shall set forth the best mode contemplated by the inventor of carrying out his invention. Claims 1-15 are rejected under 35 U.S.C. 112(a) or 35 U.S.C. 112 (pre-AIA ), first paragraph, as failing to comply with the written description requirement. The claim(s) contains subject matter which was not described in the specification in such a way as to reasonably convey to one skilled in the relevant art that the inventor or a joint inventor, or for applications subject to pre-AIA 35 U.S.C. 112, the inventor(s), at the time the application was filed, had possession of the claimed invention. Applicants are claiming in amended claim 1, a new spiro-compound that was not part of the original specification. PNG media_image1.png 420 605 media_image1.png Greyscale Applicants are amending the specification of the original spiro-compound with a new spiro-compound that is different from the previous one and this amendment to the specification and claims introduces a new matter. Applicants are also amending the original chemical structure of claim 1 as shown below to overcome a written description rejection that was raised in the previous Office Action. PNG media_image3.png 231 622 media_image3.png Greyscale As set forth in the previous rejection, the -CO-O- portion of the spiro-fused ring system in claim 1 was not attached in the same way as the spiro-fused ring system in the specification. Applicants are now claiming a generic spiro-compound formula that is not in the specification. Replacing a generic spiro-compound formula to replace the previous one is a new matter. Response to arguments Applicant’s argument filed 03/16/2026 has been fully considered but it is not persuasive. Applicants attempt to replace a spiro-compound that has no support in the specification is a new matter. The examiner recommends that applicants file an RCE for the species of EXAMPLES 1-14 disclosed in the specification. Alternatively, applicants can abandon this case and file a continuation-in-part to incorporate the generic spiro-compound as shown in amended claim 1 below. In the event a first reply is filed within TWO MONTHS of the mailing date of this final action and the advisory action is not mailed until after the end of the THREE-MONTH shortened statutory period, then the shortened statutory period will expire on the date the advisory action is mailed, and any extension fee pursuant to 37 CFR 1.136(a) will be calculated from the mailing date of the advisory action.
