DETAILED ACTION Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Claims 1-10 are pending in the instant application. Claims 1 and 5-10 are rejected. Claims 2-4 are objected. Information Disclosure Statements The information disclosure statements filed on October 25, 2023 and August 19, 2024 have been considered and signed copies of form 1449 are enclosed herewith. Specification The disclosure is objected to because of the following informalities: the figure of Scheme 1 on page 7 is difficult to read or is illegible. Appropriate correction is required. Claim Rejections - 35 USC § 112 The following is a quotation of 35 U.S.C. 112(b): (b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention. The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph: The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention. Claims 1 and 5-10 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention. With regards to claim 1, it is disclosed in step i) that a compound of Chemical Formula 3 is prepared by introducing an R2 substituent into a compound of Chemical Formula 2; therefore, it is unclear to the examiner how R2 can be defined to include hydrogen. Since hydrogen is typically what is replaced by a substituent, this renders the claims indefinite. This rejection can be overcome by deleting hydrogen from the list of possible substituents defined for R2. Claim Objections Claims 2-4 are objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims.
