Claim Rejections - 35 USC § 112
The following is a quotation of 35 U.S.C. 112(b):
(b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention.
The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph:
The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention.
Claims 1-11, and 16-21 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention.
In claim 1, line 13, the phrase “introducing a silicon source, depositing silicon” is indefinite because it is unclear whether the silicon source is deposited of elemental silicon.
In claim 1, line 13, the phrase “the interior” lacks antecedent basis in the claims.
In claim 10, line 3, the term “preferably” is indefinite because it is unclear whether the “preferable” features of the claim are required by the claim.
In claim 11, line 2, the phrase “the introducing of the silicon source” lacks antecedent basis in the claims.
Allowable Subject Matter
Claim 1 appears to contain allowable subject matter.
As allowable subject matter has been indicated, applicant's reply must either comply with all formal requirements or specifically traverse each requirement not complied with. See 37 CFR 1.111(b) and MPEP § 707.07(a).
Conclusion
The prior art made of record and not relied upon is considered pertinent to applicant's disclosure.
The prior art of CN 111554909 teaches a negative electrode material containing metal-doped silicon-based composite material, wherein the negative electrode material has a core-shell structure, comprising an inner core, an intermediate layer and a shell from inside to outside in turn; the inner core specifically comprises one or more metal doped element and silicon-based material composite to form the doped metal silicon-based composite material SiMxOy, wherein 0 <x≤ 10, 0 ≤y≤ 10, M specifically comprises Mg, Ca, Ba, Ti, Mn, Fe, Co, Ni, Cu, Zn, one or more of Zr, Mo, Ge, Sn, Al, Na and B; the shape of the metal doping element is simple substance or oxide; the intermediate layer is made of the silicon-based material; the shell is a carbon coating layer composed of continuous carbon particles or carbon films; the diameter of the negative electrode material ranges from 1um to 60um; in the negative electrode material, according to the mass ratio, the core: Intermediate layer: the shell = [20 %, 95 %]: (5 %, 60 %): (0 %, 20 %, 20 %). (Claim 1).
