The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
Drawings
The drawings are objected to as failing to comply with 37 CFR 1.84(p)(5) because they include the following reference character(s) not mentioned in the description: 61, 62, 66 in Fig. 8. Corrected drawing sheets in compliance with 37 CFR 1.121(d), or amendment to the specification to add the reference character(s) in the description in compliance with 37 CFR 1.121(b) are required in reply to the Office action to avoid abandonment of the application. Any amended replacement drawing sheet should include all of the figures appearing on the immediate prior version of the sheet, even if only one figure is being amended. Each drawing sheet submitted after the filing date of an application must be labeled in the top margin as either “Replacement Sheet” or “New Sheet” pursuant to 37 CFR 1.121(d). If the changes are not accepted by the examiner, the applicant will be notified and informed of any required corrective action in the next Office action. The objection to the drawings will not be held in abeyance.
Specification
The specification is objected to as failing to provide proper antecedent basis for the claimed subject matter. See 37 CFR 1.75(d)(1) and MPEP § 608.01(o). The following terms and phrases used in the claims fail to find clear support or antecedent basis in the description so that the meaning of the terms in the claims may be ascertainable by reference to the description. Thus it unclear what elements in the specification the claims are referring to: the “fixed bearing assembly” in claim 3, and “floating bearing assembly” in claim 6 Either the description should be amended to match the claim terminology or the claims should be amended to match the description terminology.
Claim Rejections - 35 USC § 102
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention.
(a)(2) the claimed invention was described in a patent issued under section 151, or in an application for patent published or deemed published under section 122(b), in which the patent or application, as the case may be, names another inventor and was effectively filed before the effective filing date of the claimed invention.
Claim(s) 1-8, 10, 12, 19, and 21 are rejected under 35 U.S.C. 102(a)(1) as being anticipated by Wang TW M607783U Wang discloses a drive assembly of a vehicle which is operated by of muscle power and/or motor power, the drive assembly comprising: a drive unit; 30 and an L-shaped frame interface 20 including a base 22, a lateral wall 23, and an open face 221 lying opposite the base, wherein the drive unit is mountable over the open face, and is detachably secured to the base; wherein the base is arranged on an output side of the drive unit and is substantially orthogonal to a bottom bracket axle of the drive unit, and the lateral wall is arranged substantially perpendicular to the base; further comprising a fixed bearing assembly 42 configured to releasably secure the drive unit to the base; wherein the base is screwed to at least one threaded bolt 223; wherein in a fully secured screwed, state, at least one holding region of the drive unit between a holding element 40 and the base is stressed by tension or pressure; further comprising a floating bearing assembly 31 configured to secure the holding element to one front face of the lateral wall and the drive unit; wherein the holding element is an elastically deformable plate shaped element of sheet metal, and a lid abutting a front face of the lateral wall; wherein the lid is a resilient lid and clamps the drive unit between a contact area of the lid and the base in compression; wherein the lateral wall circumferentially completely surrounds the base.
Allowable Subject Matter
Claims 9, 11, and 13-18 are objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims.
