The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
Election/Restrictions
Applicant's election with traverse of Group I (claims 1-13) and of the species: AsLOV and PhoCl2f in the reply filed on 07/13/2026 is acknowledged. Because applicant did not distinctly and specifically point out the supposed errors in the restriction requirement, the election has been treated as an election without traverse (MPEP § 818.01(a)). Claims 1-17 are pending; claims 14-17 are withdrawn from prosecution for being drawn to non-elected subject matter. Claims 1-13 are examined.
Information Disclosure Statement
The information disclosure statements (IDS) submitted on 2024/01/15 were considered by the examiner.
The listing of references in the specification is not a proper information disclosure statement. 37 CFR 1.98(b) requires a list of all patents, publications, or other information submitted for consideration by the Office, and MPEP § 609.04(a) states, "the list may not be incorporated into the specification but must be submitted in a separate paper." Therefore, unless the references have been cited by the examiner on form PTO-892, they have not been considered.
Claim Rejections - 35 USC § 112
The following is a quotation of 35 U.S.C. 112(b):
(b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention.
The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph:
The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention.
Claims 1, 3-9 and 11-13 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention.
Specifically, it is unclear where exactly is the photoactivatable linker inserted. Is it at the endogenous protease cleavage site or somewhere else between the two gasdermin domain.
As such, the metes and bounds of the claims could not be determined.
Claim Rejections - 35 USC § 102
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention.
Claims 1-4 and 11-13 are rejected under 35 U.S.C. 102(a)(1) as being anticipated by He et al. (Optogenetic Control of Non-Apoptotic Cell Death. Adv.Sci. 8, 2100424, 2021- cited by Applicant).
The reference discloses the optogenetic control of GSDMD-mediated pyroptosis by fusing GSDMD-NT and GSMD-CT fragments with a light inducible dissociation system. The photoactivatable linker dissociates upon illumination (p.6). The insertion is done in the endogenous protease cleavage region of mGSDMD (Fig.4). The optogenetic dimerization protein is Avena light-oxygen-voltage domain 2 (LOV2) (p. 2).
Thus, in the broadest reasonable interpretation, the claims 1-4 and 11-13 are anticipated by the reference cited.
Allowable Subject Matter
Claim 10 is objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims.
Conclusion
No claims are allowed. Claims 1-9 and 11-13 are rejected and claim 10 is objected to.
