DETAILED ACTION
Notice of Pre-AIA or AIA Status
The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
Response to Amendment
The amendment filed 10/17/2025 overcomes the rejection based on 35 USC section 112(a).
Response to Arguments
Applicant’s arguments with respect to claim(s) 1 and 8 have been considered but are moot because the new ground of rejection does not rely on any reference applied in the prior rejection of record for any teaching or matter specifically challenged in the argument.
Claim Rejections - 35 USC § 102
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention.
Claim(s) 1 and 8 is/are rejected under 35 U.S.C. 102(a)(1) as being anticipated by U.S. Patent Application Publication Number 2009/0067407 by Jia et al.
As to claim 1, Jia teaches a personal internet of things (IoT) network (PIN) element (device 102, paragraph 79 describes devices as types of devices commonly known as “IoT”) with management capability (PEMC) (Figures 1 and 2 show management capability of device 102) entity in a wireless communication system (Figure 1 and paragraph 77), the PEMC entity comprising: a memory (paragraph 92), a processor coupled (paragraph 90) with the memory, and a transceiver (ref. no. 106) operably coupled to the processor, the transceiver configured to: receive, from a PIN element (PINE) (device 500), a join request to join a PIN of the PEMC (paragraph 34, ref. no. 302) , and
transmit, to the PINE, information on a timer value assigned to the PINE as a response to an addition of the PINE to the PIN based on the join request (paragraph 49, ref. no. 210), the timer value indicating a periodicity of a request that the PINE transmits to the PEMC to indicate that the PINE is available within the PIN (paragraph 49) wherein a first timer corresponding to the timer value is configured in the PEMC (paragraph 50, ref. no. 212) and a second timer corresponding to the timer value is configured in the PINE (paragraph 55, ref. no. 306),
wherein the processor is configured to:
identify whether the request is received from the PINE before the first timer expires (ref. no. 218), wherein the request is transmitted before the second timer expires (ref. no. 322),
in case that the request is received from the PINE, determine an availability of the PINE as available within the PIN (paragraph 62), and in case that the first timer expires without receiving the request message from the PINE, determine the availability of the PINE as not available within the PIN (paragraph 63).
As to claim 1, it is rejected for the same reasoning as claim 8.
Conclusion
Applicant's amendment necessitated the new ground(s) of rejection presented in this Office action. Accordingly, THIS ACTION IS MADE FINAL. See MPEP § 706.07(a). Applicant is reminded of the extension of time policy as set forth in 37 CFR 1.136(a).
A shortened statutory period for reply to this final action is set to expire THREE MONTHS from the mailing date of this action. In the event a first reply is filed within TWO MONTHS of the mailing date of this final action and the advisory action is not mailed until after the end of the THREE-MONTH shortened statutory period, then the shortened statutory period will expire on the date the advisory action is mailed, and any nonprovisional extension fee (37 CFR 1.17(a)) pursuant to 37 CFR 1.136(a) will be calculated from the mailing date of the advisory action. In no event, however, will the statutory period for reply expire later than SIX MONTHS from the mailing date of this final action.
