Claim Rejections - 35 USC § 102
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention.
3. Claim(s) 1-7 is/are rejected under 35 U.S.C. 102(a)(1) as being anticipated by Matsui (US 8,530,576).
Matsui is directed to a composition comprising liquid crystal polyester resin (LCP 1), a first fluororesin or PTFE 1 (Dyneon TF9205), and a second fluororesin or PTFE 2 (Fluon L169J) (Table 1- Example 3). Matsui further states that PTFE powders having an average particle diameter less than 20 microns are used (Column 5, Lines 50+). In terms of the claimed endothermic peak temperatures, it is noted that the aforementioned PTFE materials are identical to those identified by Applicant as having endothermic peak temperatures in accordance to the claimed invention. As such, it reasons that the PTFE materials in Matsui satisfy the claimed invention.
As to claim 4, Matsui teaches the claimed repeating unit (Column 7, Lines 40+).
With respect to claim 5, the composition of Matsui includes any number of known fillers, including fibrous fillers, plate fillers, spherical fillers, powder filler, and hetero fillers (Column 12, Lines 15+).
As to claim 6, the composition in Example 3 includes approximately 27 parts of fluororesin per 100 parts of LCP (20/75).
Regarding claim 7, Matsui refers to a molded article (Column 1, Lines 5-10).
