DETAILED ACTION Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . CONTINUING DATA This application is a 371 of PCT/EP2022/068596 07/05/2022 FOREIGN APPLICATIONS EP 21305932.2 07/06/2021 A request for continued examination under 37 CFR 1.114, including the fee set forth in 37 CFR 1.17(e), was filed in this application after allowance or after an Office action under Ex Parte Quayle, 25 USPQ 74, 453 O.G. 213 (Comm'r Pat. 1935). Since this application is eligible for continued examination under 37 CFR 1.114, and the fee set forth in 37 CFR 1.17(e) has been timely paid, prosecution in this application has been reopened pursuant to 37 CFR 1.114. Claims 13-25 are pending. A notice of allowance was mailed on May 21, 2026. Upon reconsideration by the examiner, the following new rejection is made. Claim Rejections - 35 USC § 112 The following is a quotation of 35 U.S.C. 112(b): (b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention. The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph: The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention. Claims 13-25 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention. Claim 13 recites “by oxidation of hesperidin,” and “isolation by added water, filtration.” These are passive verbs and are not written as active steps. It is unclear which of these, if any, are required to be performed as an active step, or whether they are merely descriptive of the product positively recited. Claims 14-25 depend from claim 13 and incorporate all the limitations of claim 13 by reference. Claim 23 recites that the diosmin “is purified.” It is unclear whether an active step of purifying by base/acid treatment is required, or whether “purified” is merely descriptive of the diosmin. Claim 24 recites “is first reslurried,” “then filtered and rinsed.” It is unclear whether reslurrying, filtering, and rinsing are required steps, or whether they are merely descriptive. Claim 25 recites “is purified.” It is unclear whether a purifying step is required or if “is purified” is merely descriptive. Conclusion No claims are allowed.
