Claim Rejections - 35 USC § 101 07-04-01 AIA 07-04 4. 35 U.S.C. 101 reads as follows: Whoever invents or discovers any new and useful process, machine, manufacture, or composition of matter, or any new and useful improvement thereof, may obtain a patent therefor, subject to the conditions and requirements of this title. Claims 35-43 are rejected under 35 U.S.C. 101 because the claimed invention is directed to non-statutory subject matter. Independent claim 35 recites “…a computer- readable medium ...", however, claims 35-43 specifically fails to define the “ computer-readable medium ” The Examiner is therefore, broadly interpreting the “the “ computer-readable medium ” to include transitory medium which do not fall under statutory subject matter. Consequently, independent claim 35 which recites the “ computer-readable medium ” is directed to non-statutory subject matter. Appropriate corrections/rewording are required. The following is an examiner’s statement of reasons for allowance: With respect to claims 26 and 44, prior arts of record (see as listed below) fail to anticipate or render obvious, alone or in combination , the features of an apparatus for a management data analytics (MDA) function (MDAF), the device comprising processing circuitry coupled to storage, the processing circuitry configured to: decode a performance measurement request received from an MDA management service (MnS) consumer, wherein the performance measurement service request is associated with a performance measurement collection service from a location management function (LMF) including measurements for Secondary Synchronization Signal - Reference Signal Received Power (SS-RSRP), RSRP distributions, Timing Advance, or user equipment (UE) Context Release Requests; detect performance measurements data received from the LMF; and encode a measurement report based on the performance measurements data received from the LMF, alone or in combination, the limitations of claims 26, 44. Conclusion 07-96 7. The prior arts made of record and not relied upon is considered pertinent to applicant's disclosure. Yao et al (US 2021/0168643) teaches a network management system can monitor and process raw measurements of network functions (NFs). The NFs are coupled to one another via service based interfaces in a 5G network core (5GC) of a 5G network system (5GS). A server producer generates performance measurements corresponding to the one or more NFs based on the raw measurements. The performance measurements are used to evaluate and optimize the performance related to network services enablement (See Abstract). Sosnin et al (US 2022/0053436) teaches an apparatus of an LMF node includes processing circuitry coupled to a memory. To configure the LMF node for UE location determination in a 5G NR network, the processing circuitry is to decode a measurement report message from a first Next Generation Node-B (gNBi). The measurement report message indicates a time difference (Δtij) between an actual measured propagation time delay (tij) and a reference propagation time delay (Tij) between the gNBi and at least a second gNB (gNBj). TSirokinhe processing circuitry further performs an estimation of a UE location based on the measurement response and adjusts the estimation based on the time difference (See Abstract). Sirotkin (US 2021/0168755) teaches the positioning methods mentioned above rely on the following measurements which can be requested by the LMF from a gNB: synchronization signal reference signal received power ( SS-RSRP ); synchronization signal reference signal received quality (SS-RSRQ); channel state information reference signal received power (CSI-RSRP); channel state information reference signal received quality (CSI-RSRQ); gNB receive (Rx)−transmit (Tx) time difference; uplink (UtL) sounding reference signal (SRS) reference signal received power (UL SRS-RSRP); UL angle of arrival information; UL relative time of arrival (UL RTOA); and UL-SRS-RSRP (paragraph [0041]).
