DETAILED ACTION Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Claim Rejections - 35 USC § 102 The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action: A person shall be entitled to a patent unless – (a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention. Claims 1-6 are rejected under 35 U.S.C. 102(a)(1) as being anticipated by Gaspard et al. (US 8,920,296 B2). Claim 1: Gaspard et al. discloses a forged steel roll for cold rolling with a Vickers hardness Hv at 400°C of 400 or more (Col. 5, Lines 27-28). Claim 2: Gaspard et al. further discloses the forged steel roll having a chemical composition comprising, by mass%, C: 0.70 to 1.50% (Table 1, 0.8-0.99), Si: 0.40 to 1.50% (Table 1, 0.2-2.0), Mn: 0.20 to 1.50% (Table 1, 0.2-0.5), P: 0.030% or less (Table 1, less than 0.015), S: 0.0200% or less (Table 1, less than 0.015), Al: 0.050% or less (Col. 11, Lines 63-67 less than 0.4), N: 0.0200% or less (Col. 11, Lines 63-67 less than 0.4), O: 0.0050% or less (Col. 11, Lines 63-67 less than 0.4), Cr: 2.80 to 8.00% (Table 1, 7.0-13.0), Mo: 0.30 to 3.00% (Table 1, 0.6-1.6), Cu: 0.100% or less (Col. 11, Lines 63-67 less than 0.4), B: 0.0100% or less (the composition has no B which is less than 0.01), Ni: 0 to 1.20% (Table 1, less than 1.0), V: 0 to 2.00% (Table 1, 1.0-3.0), Nb: 0 to 1.00% (Table 1, 0.0-0.5), and balance: Fe and impurities (Col. 12, Lines 9-11), and satisfying the following formula 1: 4.50 Cr+Mo+V+Nb 14.00 (Table 1, Cr 7, Mo 0.6, Mo 1.0, Nb 0.05 for example) " formula 1 wherein the contents (mass%) of the elements entered in the symbols of the elements in formula 1, and 0 is entered in the case where the elements are not included. Claim 3: Gaspard et al. further discloses the forged steel roll for cold rolling wherein the chemical composition contains, by mass%, at least one selected from the group consisting of Ni: 0.05 to 1.20% (Table 1, less than 1.0), V: 0.10 to 2.00% (Table 1, 1.0-3.0), and Nb: 0.10 to 1.00% (Table 1, 0.0-0.5). Claims 4-6: Gaspard et al. further discloses the forged steel roll for cold rolling wherein a shrinkage start temperature in a temperature elevation process is 300°C or more (see Examples 1 and 2, the shrinkage start temperature is 1400°C to 1200°C and solidification occurs at a rate of 50° C/min).
