Office Action

§102
DETAILED ACTION Continued Examination Under 37 CFR 1.114 A request for continued examination under 37 CFR 1.114, including the fee set forth in 37 CFR 1.17(e), was filed in this application after allowance or after an Office action under Ex Parte Quayle, 25 USPQ 74, 453 O.G. 213 (Comm'r Pat. 1935). Since this application is eligible for continued examination under 37 CFR 1.114, and the fee set forth in 37 CFR 1.17(e) has been timely paid, prosecution in this application has been reopened pursuant to 37 CFR 1.114. Applicant's submission filed on August 12, 2026 has been entered. Claim Rejections - 35 USC § 102 In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA ) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status. The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action: A person shall be entitled to a patent unless – (a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention. Claim(s) 14, 17 and 19 is/are rejected under 35 U.S.C. 102(a)(1) as being anticipated by CN107499200A. Note a base for a child safety seat, the base comprising: a base bracket (11), a telescopic tube (21) provided with a plurality of locking portions (22) in a length direction thereof, an operating assembly comprising a locking member (43) connected to the base bracket, wherein the locking member is capable of being operated to engage with one of the locking portions, such that the telescopic tube and the base bracket are mutually locked, and the locking member is capable of being operated to disengage from the one of the locking portions, such that the telescopic tube and the base bracket are capable of sliding relative to each other, and a linkage rod (60)having a first end and a second end, wherein the operating assembly comprises a first operating assembly (41, 61) and a second operating assembly (42, 62), the base bracket comprises a first side and a second side spaced apart from the first side, the first side of the base bracket is provided with the first operating assembly and the second side of the base bracket is provided with the second operating assembly, and the first end of the linkage rod is fixed on the locking member of the first operating assembly and the second end of the linkage rod is fixed on the locking member of the second operating assembly (see Figure 4). Regarding claim 17, note the locking member is provided with a male connecting portion (tip of 43), and the locking portions are female connecting portions (openings forming 22) capable of engaging with the male connecting portion, or the locking member is provided with an engaging protrusion (tip of 43), and the locking portion is an engaging hole (opening forming 22) capable of cooperating with the engaging protrusion. See Figures 3-5. Regarding claim 19, note at least one of the first operating assembly and the second operating assembly further comprises an operating member capable of being operated to drive the locking member to engage with or disengage from the locking portion. Claim(s) 22 is/are rejected under 35 U.S.C. 102(a)(1) as being anticipated by CN107499200A. Note a base for a child safety seat, the base comprising: a base bracket (11), a telescopic tube (21) provided with a plurality of locking portions (22) in a length direction thereof, an operating assembly comprising: a locking member (43) connected to the base bracket, and an operating member (31) having a first position (one of pressed or unpressed/released) and a second position (the other of pressed or unpressed/released), wherein, when the operating member is in the first position, the operating member is capable of being operated to drive (i.e. to force engagement or disengagement) the locking member, and when the operating member is in the second position, the operating member and the locking member are spaced apart from each another (see Figure 1), wherein the locking member is capable of being operated to engage with one of the locking portions (when the operating member is unpressed/released), such that the telescopic tube and the base bracket are mutually locked, and the locking member is capable of being operated to disengage from the one of the locking portions (when the operating member is pressed), such that the telescopic tube and the base bracket are capable of sliding relative to each other. Allowable Subject Matter Claims 1-5 and 8-13 are allowed. Claims 15-16, 18, and 20-21 are objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims. Response to Amendment Applicant’s filing of August 12, 2026 has been fully considered. Amendments have necessitated an updated search and reevaluation of the claims. Newly discovered prior art has been applied where appropriate. Note as outlined above.
