CTNF 18/580,896 CTNF 78117 Notice of Pre-AIA or AIA Status 07-03-aia AIA 15-10-aia The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA. Claim Rejections - 35 USC § 102 07-07-aia AIA 07-07 The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action: A person shall be entitled to a patent unless – 07-08-aia AIA (a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention. 07-15 AIA Claim 1 is rejected under 35 U.S.C. 102( a)(1 ) as being anticipated by KR-10-2035826 . KR’826 discloses (see Figs 1-5) a die coater comprising: a lower block (lower die 20) including a manifold configured to accommodate an electrode slurry (see Abstract); an upper block (upper die 10) coupled to the lower block (20) and including an insulating liquid inlet (supply pipe 41 and vertical passage 11); and a coater shim (simple rate 50) interposed between the upper block (10) and the lower block (20), wherein the coater shim (50) includes a first coater shim (passage 51) and a second coater shim (53), the first coater shim (51) having a first slit (see Figs 4-5) capable of discharging the electrode slurry (supplied through slurry supply pipe 30 and dam part 21) accommodated in the manifold and the second coater shim (53) having a second slit (see Fig 3-5) capable of discharging an insulating liquid supplied through the insulating liquid inlet (supply pipe 41 and vertical passage 11), and wherein the second coater shim is (53) capable of being pressed by a fixing bolt (fastener 43) that is screw-coupled to the insulating liquid inlet (see Fig 1-2 for supply pipe 41 with vertical passage 1, and fastener 43) . Claim Rejections - 35 USC § 103 07-20-aia AIA The following is a quotation of 35 U.S.C. 103 which forms the basis for all obviousness rejections set forth in this Office action: A patent for a claimed invention may not be obtained, notwithstanding that the claimed invention is not identically disclosed as set forth in section 102, if the differences between the claimed invention and the prior art are such that the claimed invention as a whole would have been obvious before the effective filing date of the claimed invention to a person having ordinary skill in the art to which the claimed invention pertains. Patentability shall not be negated by the manner in which the invention was made. 07-20-02-aia AIA This application currently names joint inventors. In considering patentability of the claims the examiner presumes that the subject matter of the various claims was commonly owned as of the effective filing date of the claimed invention(s) absent any evidence to the contrary. Applicant is advised of the obligation under 37 CFR 1.56 to point out the inventor and effective filing dates of each claim that was not commonly owned as of the effective filing date of the later invention in order for the examiner to consider the applicability of 35 U.S.C. 102(b)(2)(C) for any potential 35 U.S.C. 102(a)(2) prior art against the later invention. 07-21-aia AIA Claim (s) 2-3 are rejected under 35 U.S.C. 103 as being unpatentable over KR-10-2035826 in view of KR-102134587 . KR’826’s die coater is capable of having the claimed width or height of slit of the coater shim. In any event, a coating apparatus having with a lower die, an upper die and shim member, wherein different sizes of shim members are used (see English Translation on page 4) is known in the art. It would have been obvious to one of ordinary skill in the art before the effective filing date of the claimed invention to include first and second coater shims having the claimed width and height of the slit depending on the desired application shape as taught (see English Translation on page 4) . 12-151-08 AIA 07-43 12-51-08 Claim s 4-13 are objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims. 13-03-01 AIA The following is a statement of reasons for the indication of allowable subject matter: in KR’826, the closest prior art of record, the fixing bolt (fastener 43) does not define a hollow part configured to receive the insulating liquid to be supplied to the second slit .
