Claim Rejections - 35 USC § 102
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention.
(a)(2) the claimed invention was described in a patent issued under section 151, or in an application for patent published or deemed published under section 122(b), in which the patent or application, as the case may be, names another inventor and was effectively filed before the effective filing date of the claimed invention.
Claim 1 is rejected under 35 U.S.C. 102(a)(1) as being anticipated by Tung in US Publication 2010/0212705. Tung teaches an outdoor sunshade, comprising: a sunshade post (12); a sunshade frame (3) located on one side of the sunshade post; a handle shell (14) arranged on the sunshade post, wherein the handle shell can move vertically along the sunshade post (see Figs. 1 and 2); an inclined pull rod (4) arranged on the handle shell in a matching manner, the other end of the inclined pull rod matching the sunshade frame; a sunshade cord (13); a sunshade cord winding and unwinding assembly configured to wind or unwind the sunshade cord so as to unfold or fold the sunshade frame; the sunshade cord winding and unwinding assembly comprising a first power component (51) and a second power component (147), wherein the first power component is located in the handle shell and completes power input by means of a driving component (52), and wherein the first power component and the second power component are in power transmission fit (via the portion of cord between 45 and 51); and a cord winding wheel (45) arranged on the second power component in a matching manner, wherein the second power component extends outwards in an axial direction of the inclined pull rod such that the cord winding wheel is located outside the handle shell (see Fig. 4).
Allowable Subject Matter
Claims 2-5 are objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims.
Response to Arguments
Applicant's arguments filed 3/6/2026 have been fully considered but they are not persuasive.
With respect to the applicant’s arguments regarding the Tung reference: please see clarified rejections set forth above. The winding wheel (pulley surface of 45) taught by Tung is an element around which the cord wraps during activation of the drive means of the device, and is driven to move upon motion of the first power component 51 by the portion of cord therebetween. As such, it is considered sufficient to meet the limitations of the claim.
Conclusion
THIS ACTION IS MADE FINAL. Applicant is reminded of the extension of time policy as set forth in 37 CFR 1.136(a).
A shortened statutory period for reply to this final action is set to expire THREE MONTHS from the mailing date of this action. In the event a first reply is filed within TWO MONTHS of the mailing date of this final action and the advisory action is not mailed until after the end of the THREE-MONTH shortened statutory period, then the shortened statutory period will expire on the date the advisory action is mailed, and any nonprovisional extension fee (37 CFR 1.17(a)) pursuant to 37 CFR 1.136(a) will be calculated from the mailing date of the advisory action. In no event, however, will the statutory period for reply expire later than SIX MONTHS from the mailing date of this final action.
