RESPONSE TO ELECTION/RESTRICTION
Applicant’s election without traverse of group I, drawn to a method of making compound of the formula I in at least 98% purity in the reply filed on 8/7/2026 is acknowledged.
The requirement is still deemed proper and is therefore made FINAL.
Claims 30-32 are withdrawn from further consideration pursuant to 37 CFR 1.142(b), as being drawn to a nonelected invention, there being no allowable generic or linking claim.
An action on the merits of claims 1,3,6-8,10-12,14,16-17,20 and 22-28 is contained herein.

Claim Objections
Claims 11, 12, 14, 16, 17, and 20, 22-28 are objected to because of the following informality: The preamble of claim 11 should be amended to delete the recitation “the method comprising:” since the language “is prepared by” is recited previously. Thus the claim and claims dependent on it which do not rectify the issue are objected to. Correction is required.
Claim Rejections - 35 USC § 112
The following is a quotation of 35 U.S.C. 112(b):
(b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention.
The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph:
The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention.
Claims 1,3,6-8,11-12,14,16-17,20, and 22-28 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor, or for pre-AIA the applicant regards as the invention.
In the instant claims 1 and 27, the language “conditions suitable” is not readily ascertained by the skilled artisan. The claims do not articulate these “conditions” or the specification as filed to meet the desired yield and purity limitations required in the claims. Thus, the scope of the claim and claims dependent on it which do not rectify the issue are considered indefinite. The examiner suggests incorporating language into the claims that clearly articulate the metes and bounds of this language

Claim Rejections - 35 USC § 112
The following is a quotation of 35 U.S.C. 112(d):
(d) REFERENCE IN DEPENDENT FORMS.—Subject to subsection (e), a claim in dependent form shall contain a reference to a claim previously set forth and then specify a further limitation of the subject matter claimed. A claim in dependent form shall be construed to incorporate by reference all the limitations of the claim to which it refers.
The following is a quotation of 35 U.S.C. 112 (pre-AIA ), fourth paragraph:
Subject to the [fifth paragraph of 35 U.S.C. 112 (pre-AIA )], a claim in dependent form shall contain a reference to a claim previously set forth and then specify a further limitation of the subject matter claimed. A claim in dependent form shall be construed to incorporate by reference all the limitations of the claim to which it refers.
Claim 23 is rejected under 35 U.S.C. 112(d) or pre-AIA 35 U.S.C. 112, 4th paragraph, as being of improper dependent form for failing to further limit the subject matter of the claim upon which it depends, or for failing to include all the limitations of the claim upon which it depends. Claim 23 does not further limit claim 22 since this claim or any other preceding claim which it is dependent on recites “the first (or third) crystallization mixture”.
Applicant may cancel the claim(s), amend the claim(s) to place the claim(s) in proper dependent form, rewrite the claim(s) in independent form, or present a sufficient showing that the dependent claim(s) complies with the statutory requirements.
Conclusion
Claims 1,3,6-8,11-12,14,16-17,20, and 22-28 are rejected. Claim 10 is objected to as being dependent upon a rejected base claim but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims. There is no relevant art to be put on the record by the examiner.
