Claim Rejections - 35 USC § 102
In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA ) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status.
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(2) the claimed invention was described in a patent issued under section 151, or in an application for patent published or deemed published under section 122(b), in which the patent or application, as the case may be, names another inventor and was effectively filed before the effective filing date of the claimed invention.
2. Claims 21-40 are rejected under 35 U.S.C. 102(a)(2) as being anticipated by Talebi Fard et al. US 20200351980 hereafter Fard.

and receiving, by the first terminal device [i.e. UE (User equipment) or Admin User/Requesting Entity/Subscriber/Customer/Wireless Device/UE-T], a second message from the first network device [i.e. SMF/AMF see 0043, 0046], wherein the second message indicates to accept the request to establish the first session [Figs. 19-20, Sections 0206, 0223, 0236: After receiving the request from UE, the SMF send a PDU Session Accept message to the UE for data communication. The UE send a service request message to the network comprise an indication for the cause; the network receive the indication and the UE receives a service accept message indicate that activation of user plane for the group has been initiated or completed. As to Claim 23. (New) Fard discloses the method according to claim 22, further comprising [Title: Group Communication Service request]: when the application corresponding to the parameter describing the application matches an application run by the first terminal device [Section 0074, 0264: PDU sessions established upon UE request using NAS SM signaling exchanged between the UE and the SMF and the identified application in UE establish a PDU session to a specific DNN (data network name). As to Claim 24.
