Claim Rejections - 35 USC § 102

Claim(s) 18 is/are rejected under 35 U.S.C. 102(a)(1) as being anticipated by Shioji (PG Pub 2017/0331009 A1).
Regarding claim 18, Shioji teaches an optoelectronic semiconductor chip comprising: a semiconductor layer sequence having an active zone (22, fig. 1B, paragraph [0028]) for generating radiation with a wavelength of maximum intensity L; and a mirror (4) for the radiation on a rear side opposite a light extraction side, wherein the mirror comprises at least one cover layer (the first layer of the stack of layers in DBR 4, paragraph [0038]), a contact layer (32) arranged directly between the at least one cover layer and the semiconductor layer sequence, wherein the cover layer is formed with a material transparent to the radiation and has an optical of at most 5 L inclusive (λ/4n, paragraph [0038]), the cover layer is followed by several intermediate layers (the other layers in stack 4, paragraph [0038]) in a direction away from the semiconductor layer sequence, the intermediate layers have alternately high and low refractive indices (paragraph [0038]) for the radiation and are each made of a material transparent to the radiation, and the intermediate layers are followed in the direction away from the semiconductor layer sequence by at least one metal layer (silver 61, paragraph [0080]) as a reflection layer.
Response to Arguments
Applicant’s arguments with respect to claim(s) 21 have been considered but are moot because the new ground of rejection does not rely on any reference applied in the prior rejection of record for any teaching or matter specifically challenged in the argument. See rejection above.
Allowable Subject Matter
Claims 1-16 and 19 are allowed.
The following is a statement of reasons for the indication of allowable subject matter: Prior art does not teach
“a contact layer arranged directly between the at least one cover layer and the semiconductor layer sequence, wherein the cover layer is formed with a material transparent to the radiation and has an optical of at least 0.5 L inclusive” (claims 1 and 19).
Conclusion
Applicant's amendment necessitated the new ground(s) of rejection presented in this Office action. Accordingly, THIS ACTION IS MADE FINAL. See MPEP § 706.07(a). Applicant is reminded of the extension of time policy as set forth in 37 CFR 1.136(a).
A shortened statutory period for reply to this final action is set to expire THREE MONTHS from the mailing date of this action. In the event a first reply is filed within TWO MONTHS of the mailing date of this final action and the advisory action is not mailed until after the end of the THREE-MONTH shortened statutory period, then the shortened statutory period will expire on the date the advisory action is mailed, and any nonprovisional extension fee (37 CFR 1.17(a)) pursuant to 37 CFR 1.136(a) will be calculated from the mailing date of the advisory action. In no event, however, will the statutory period for reply expire later than SIX MONTHS from the mailing date of this final action.
