The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
Status of Claims
Clams 1 – 8 are pending.
Claims 1 – 8 are rejected.
Drawings
The drawings are objected to as failing to comply with 37 CFR 1.84(p)(5) because they include the following reference character(s) not mentioned in the description: “R1” in Figures 3 and 4. Corrected drawing sheets in compliance with 37 CFR 1.121(d), or amendment to the specification to add the reference character(s) in the description in compliance with 37 CFR 1.121(b) are required in reply to the Office action to avoid abandonment of the application. Any amended replacement drawing sheet should include all of the figures appearing on the immediate prior version of the sheet, even if only one figure is being amended. Each drawing sheet submitted after the filing date of an application must be labeled in the top margin as either “Replacement Sheet” or “New Sheet” pursuant to 37 CFR 1.121(d). If the changes are not accepted by the examiner, the applicant will be notified and informed of any required corrective action in the next Office action. The objection to the drawings will not be held in abeyance.
Specification
The specification is objected to as failing to provide proper antecedent basis for the claimed subject matter. See 37 CFR 1.75(d)(1) and MPEP § 608.01(o). Correction of the following is required: Figures 3 and 4 reference “R1”. There is no support in the disclosure for substituent “R1” in the current figures 3 and 4.
Claim Objections
Claims 1 – 8 are objected to because of the following informalities: Claim 1 should begin “A process…”; and claims 2 – 8 should begin with “The process…” because they are dependent claims. Appropriate correction is required.
Claim 1 is objected for making reference to Figures 2, and 4 in the claim. here possible, claims are to be complete in themselves. Incorporation by reference to a specific figure or table "is permitted only in exceptional circumstances where there is no practical way to define the invention in words and where it is more concise to incorporate by reference than duplicating a drawing or table into the claim. In this instance there was a practical way to define the chemical structures in the claim.
Claim Rejections - 35 USC § 112
The following is a quotation of 35 U.S.C. 112(b):
(b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention.
Claims 1- 8 are rejected under 35 U.S.C. 112(b), as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor, regards as the invention.
Claims 1 – 8 are rendered indefinite for containing both process of making and process of use limitations in the same claim. The claims is ambiguous because it is not clear from claim 1 what the focus of the claim should be the process of making the chemicals of figures 2, 3 and 4 or the process of using the chemicals of figures 2, 3 and 4. In Ex parte Lyell, 17 USPQ2d 1548 (Bd. Pat. App. & Inter. 1990), claim directed to an automatic transmission workstand and the method of using it held ambiguous and properly rejected under 35 USC 112, second paragraph.
Regarding claim 4, the phrase "such as" renders the claim indefinite because it is unclear whether the limitations following the phrase are part of the claimed invention. See MPEP § 2173.05(d).

Allowable Subject Matter
The compound of Figure 2 appears to be allowable.
