Claim Rejections - 35 USC § 112
The following is a quotation of 35 U.S.C. 112(d):
(d) REFERENCE IN DEPENDENT FORMS.—Subject to subsection (e), a claim in dependent form shall contain a reference to a claim previously set forth and then specify a further limitation of the subject matter claimed. A claim in dependent form shall be construed to incorporate by reference all the limitations of the claim to which it refers.
The following is a quotation of pre-AIA 35 U.S.C. 112, fourth paragraph:
Subject to the following paragraph [i.e., the fifth paragraph of pre-AIA 35 U.S.C. 112], a claim in dependent form shall contain a reference to a claim previously set forth and then specify a further limitation of the subject matter claimed. A claim in dependent form shall be construed to incorporate by reference all the limitations of the claim to which it refers.
Claim 3 is rejected under 35 U.S.C. 112(d) or pre-AIA 35 U.S.C. 112, 4th paragraph, as being of improper dependent form for failing to further limit the subject matter of the claim upon which it depends, or for failing to include all the limitations of the claim upon which it depends. Claim 1 requires that the flowmeter is multiphrase, accordingly, the contradictory substitution of a single-phase flowmeter does not “include all the limitations of the claim upon which it depends”. Applicant may cancel the claim(s), amend the claim(s) to place the claim(s) in proper dependent form, rewrite the claim(s) in independent form, or present a sufficient showing that the dependent claim(s) complies with the statutory requirements.
Allowable Subject Matter
Claims 1-2 and 4-20 are allowed.
The following is an examiner’s statement of reasons for allowance:
Considering claim 1, the prior art made of record fails to disclose, suggest or otherwise render obvious the subject matter of an apparatus having a rotating flow intake assembly, a multiphase flowmeter, a blower, and a main controller board configured to execute wind functions and use a neural network to reduce Gaussian noise to output wind velocity and wind direction.
Considering claim 11, the prior art made of record fails to disclose, suggest or otherwise render obvious the subject matter of a method for calculating wind parameters having the steps of sampling air using an airflow meter with a rotating flow intake assembly and a multiphase flowmeter, generating a wind function, using a neural network to solve the wind function for wind velocity and obtaining one or more wind directional angles from the wind function.
Considering claim 16, the prior art made of record fails to disclose, suggest or otherwise render obvious the subject matter of a system for calculating wind parameters having a rotating flow intake assembly, a multiphase flowmeter, a controller board in operable communication with the rotating flow intake assembly and the multiphase flow meter, wherein the rotating flow intake assembly sends measured data to the controller board and the controller board constructs and solves a wind function to output one or more values.
Any comments considered necessary by applicant must be submitted no later than the payment of the issue fee and, to avoid processing delays, should preferably accompany the issue fee. Such submissions should be clearly labeled “Comments on Statement of Reasons for Allowance.”
Conclusion
The prior art made of record and not relied upon is considered pertinent to applicant's disclosure.
Santos discloses a turbine outfitted with rotating air intake assemblies and flow sensors that utilizes hot wire resistance techniques to detect wind speed. Santos fails to disclose a multi-phase flowmeter and the use of neural networks to reduce noise.
Demangeot et al. discloses an air intake assembly that causes the circulation/rotation of air towards a flowmeter for determining flow rate.
