Office Action

§102
DETAILED ACTION Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Drawings The drawings are objected to because the drawing (fig. 3) discloses that the battery is charged (78) when the battery temperature is not in optimal charging temperature range (76) and the battery temperature is adjusted (80) when the battery temperature is in optimal charging temperature range (76). However, the examiner will consider that that the battery is charged (78) when the battery temperature is in optimal charging temperature range (76) and the battery temperature is adjusted (80) when the battery temperature is not in optimal charging temperature range (76) as described in speciation (see paragraph 0035 of the specification). Corrected drawing sheets in compliance with 37 CFR 1.121(d) are required in reply to the Office action to avoid abandonment of the application. Any amended replacement drawing sheet should include all of the figures appearing on the immediate prior version of the sheet, even if only one figure is being amended. The figure or figure number of an amended drawing should not be labeled as “amended.” If a drawing figure is to be canceled, the appropriate figure must be removed from the replacement sheet, and where necessary, the remaining figures must be renumbered and appropriate changes made to the brief description of the several views of the drawings for consistency. Additional replacement sheets may be necessary to show the renumbering of the remaining figures. Each drawing sheet submitted after the filing date of an application must be labeled in the top margin as either “Replacement Sheet” or “New Sheet” pursuant to 37 CFR 1.121(d). If the changes are not accepted by the examiner, the applicant will be notified and informed of any required corrective action in the next Office action. The objection to the drawings will not be held in abeyance. Claim Rejections - 35 USC § 102 In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA ) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status. The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action: A person shall be entitled to a patent unless – (a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention. Claim(s) 1-3 is/are rejected under 35 U.S.C. 102(a)(1) as being anticipated by Neligan et al. (EP 3890098). Re claim 1: Neligan teaches a method of charging a battery of an electric vehicle comprising plugging the electric vehicle (2) into a charging station (1); measuring a temperature of the battery using a temperature determination unit (2C); and adjusting the temperature of the battery to be within a charging temperature range using power supplied from the charging station (i.e., a medium temperature adjustment unit (1B) adjusting medium temperature using a power from the charging station (1) prior to supplying the medium to a battery conditioning unit (2B) for adjusting temperature of the battery (2A), paragraph 0028)(see figs. 1, 2; paragraphs 0026-0033). Re claim 2: The method including charging the battery after the battery temperature is within the charging temperature range (paragraph 0024). Re claim 3: Wherein adjusting the temperature of the battery includes heating and or cooling the battery (paragraphs 0036). Allowable Subject Matter Claims 12-17 are allowed. Claims 4-11 are objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims. The following is a statement of reasons for the indication of allowable subject matter: None of prior art teaches the method of charging a battery of an electric vehicle including adjusting electrical parameters of the power provided by the charging station to the electrical vehicle to match power requirements of a vehicle heating and cooling system, adjusting electrical parameters of the power supplied by the charging station to match electrical parameters of the electric vehicle battery output when the battery temperature is outside of the charging temperature range and a charge level of the electric vehicle battery is below a first charge level, and wherein adjusting the temperature of the battery includes: powering a battery heating and cooling system of the electric vehicle with the power supplied from the charging station if the measured temperature is outside of a predetermined charging temperature range and a state of charge of the battery is less than a predetermined charge level, and an electric vehicle (EV) charging station (1) comprising a charging station controller to communicate with the EV to determine a temperature and a charge level of a battery of the EV, if the temperature is outside of a charging temperature range and the charge level is below a threshold level, the station controller to direct the power supply to provide to the EV a power output having electrical parameters to enable the EV to adjust the battery temperature to be within the charging temperature range using the power output from the EV charging station as set forth in the claims. Conclusion The prior art made of record and not relied upon is considered pertinent to applicant's disclosure. Lee et al. (US 2023/0415593), Tomai et al. (US 11342603), and Fujikawa et al. (US 11942612) teach battery management systems.
