Office Action

§102
DETAILED ACTION Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Response to Arguments Applicant's arguments filed 7/10/26 have been fully considered but they are not persuasive. The applicant submits the prior art does not disclose the following limitations of the claimed invention: a first male member/female member pair to block the cover in a first position and a second male member/female member to block the cover in a second position; and at least one first member, which may be male or female, and at least one second member, which may be male or female, arranged on one of said main faces of the protection, the first member belonging to the first male/female member pair and the second member belonging to the second male/female member pair, wherein the first member and the second member are arranged on opposite sides of the main face, as stated in claim 1. The Examiner respectfully disagrees. Re claim 1) The Clark reference discloses a shutter wherein the first male member/female member pair (see figure 1A-1D, element 104 and 108) to block the cover in a first position (see figure 1A) and a second male member/female member (see figure 1A-1D, elements 110 and 114) to block the cover in a second position (see figure 1C); and at least one first member (see figure 1C, element 108), which may be male or female, and at least one second member (see figure 1C, element 110), which may be male or female, arranged on one of said main faces of the protection, the first member belonging to the first male/female member pair and the second member belonging to the second male/female member pair, wherein the first member and the second member are arranged on opposite sides of the main face (see figure 1C and para 9-12: the first member (108) and second member (110) are on the opposite sides on the main face of the cover (106) with the protection). Therefore, the reference discloses all the limitations of the claimed invention. Claim Rejections - 35 USC § 102 In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA ) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status. The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action: A person shall be entitled to a patent unless – (a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention.
