DETAILED ACTION
Notice of Pre-AIA or AIA Status
The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
Claim Objections
Claims 12 and 13 are objected to because of the following informalities:
As to claim 12, the limitations, “the first Bluetooth playing device (21) has the apparatus according to claim 6; and the second Bluetooth playing device (22) has the apparatus according to claim 6” should be rewritten as --- the first Bluetooth playing device (21) and the second Bluetooth playing device (22) have the apparatuses according to claim 6
Claim 13 is objected to as being dependent upon an objected base claim.
Claim Rejections - 35 USC § 101
35 U.S.C. 101 reads as follows:
Whoever invents or discovers any new and useful process, machine, manufacture, or composition of matter, or any new and useful improvement thereof, may obtain a patent therefor, subject to the conditions and requirements of this title.
Claim 14 is rejected under 35 U.S.C. 101 because the claimed invention is directed to non-statutory subject matter. Claims 14 recite “computer-readable storage medium” which is not clearly defined to exclude non-statutory transitory medium such as signal or transmission medium. The 35 U.S.C. 101 rejection(s) can be overcome if the claim(s) recites "non-transitory computer-readable storage medium” and the specification amended to recite that the medium is a non-transitory computer-readable storage medium. In paragraphs [0050] and [0113] of specification discloses, "a computer-readable storage medium”. The medium can include signal which is non-statutory because it is not considered as process, machine, manufacture, or composition of matter, or any new and useful improvement. Because the claim may be directed toward a signal the claim as a whole is considered non-statutory.
Allowable Subject Matter
The following is a statement of reasons for the indication of allowable subject matter:
As to claim 1, the record of record of prior arts fail to disclose the combination of limitations, step S300: controlling, at a local link subevent anchor, the first Bluetooth playing device (21) to receive first current audio data that is sent to the first Bluetooth playing device (21) by the audio source device (20), wherein during the period, the second Bluetooth playing device (22) listens to the first current audio data, and the local link subevent anchor is a time point at which the audio source device (20) sends audio data to the first Bluetooth playing device (21) over the first communication link (CIS1); step S400: when the first current audio data is not received at the local link subevent anchor, controlling the first Bluetooth playing device (21) to send, a preset time interval after the local link subevent anchor, a first forwarding request to the second Bluetooth playing device (22) over the information exchange link (CTRL), so that the second Bluetooth playing device (22) forwards the first current audio data; and step S500: controlling, at the arrival of an agreed anchor, the first Bluetooth playing device (21) to receive the first current audio data that is forwarded by the second Bluetooth playing device (22) based on the first forwarding request.
As to claim 6, the record of record of prior arts fail to disclose the combination of limitations, a first receiving module (300), configured to control, at a local link subevent anchor, the first Bluetooth playing device (21) to receive first current audio data that is sent to the first Bluetooth playing device (21) by the audio source device (20), wherein during the period, the second Bluetooth playing device (22) listens to the first current audio data, and the local link subevent anchor is a time point at which the audio source device (20) sends audio data to the first Bluetooth playing device (21) over the first communication link (CIS1); a request sending module (400), configured to: when the first current audio data is not received at the local link subevent anchor, control the first Bluetooth playing device (21) to send, a preset time interval after the local link subevent anchor, a first forwarding request to the second Bluetooth playing device (22) over the information exchange link (CTRL), so that the second Bluetooth playing device (22) forwards the first current audio data; and a second receiving module (500), configured to control, at the arrival of an agreed anchor, the first Bluetooth playing device (21) to receive the first current audio data that is forwarded by the second Bluetooth playing device (22) based on the first forwarding request.
