DETAILED ACTION Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Continued Examination Under 37 CFR 1.114 A request for continued examination under 37 CFR 1.114, including the fee set forth in 37 CFR 1.17(e), was filed in this application after final rejection. Since this application is eligible for continued examination under 37 CFR 1.114, and the fee set forth in 37 CFR 1.17(e) has been timely paid, the finality of the previous Office action has been withdrawn pursuant to 37 CFR 1.114. Applicant's submission filed on 12/9/2025 has been entered. Election/Restrictions Claim 16 is withdrawn from further consideration pursuant to 37 CFR 1.142(b) as being drawn to a nonelected invention, there being no allowable generic or linking claim. Allowable Subject Matter Claims 1, 2, 4-7, 9-11, and 13-15 are allowed for the reasons provided by Applicant on pages 9-10 of the Remarks filed 12/9/2025. Any comments considered necessary by applicant must be submitted no later than the payment of the issue fee and, to avoid processing delays, should preferably accompany the issue fee. Such submissions should be clearly labeled “Comments on Statement of Reasons for Allowance.” Response to Arguments Applicant’s arguments, see pages 9-10 of the Remarks filed 12/9/2025, with respect to the 103 rejections have been fully considered and are persuasive. The 103 rejections have been withdrawn. Claim Rejections - 35 USC § 112 The following is a quotation of 35 U.S.C. 112(b): (b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention. The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph: The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention. Claims 3, 8, 12 rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention. Claims 3 and 12 recite, “a portion of a polynomial expression”. The claim is incomplete for omitting essential elements, such omission amounting to a gap between the elements. See MPEP § 2172.01. It is unclear what the polynomial expression is because it is not recited. Therefore, it is impossible to determine “a portion” of an unknown expression since it is relative to the unknown expression. Claim 8 recites, “wherein the second computational circuit implements a repeated polynomial sub-expression that is a common portion of polynomial expressions in Berlekamp discrepancy determinations for multiple iterations of the Berlekamp algorithm.” It is unclear whether “common” in this context means “occurring often”; or whether it means “shared by more than one”.
