CTNF 18/617,403 CTNF 85190 DETAILED ACTION Claim Rejections - 35 USC § 112 07-30-01 AIA The following is a quotation of the first paragraph of 35 U.S.C. 112(a): (a) IN GENERAL.—The specification shall contain a written description of the invention, and of the manner and process of making and using it, in such full, clear, concise, and exact terms as to enable any person skilled in the art to which it pertains, or with which it is most nearly connected, to make and use the same, and shall set forth the best mode contemplated by the inventor or joint inventor of carrying out the invention. The following is a quotation of the first paragraph of pre-AIA 35 U.S.C. 112: The specification shall contain a written description of the invention, and of the manner and process of making and using it, in such full, clear, concise, and exact terms as to enable any person skilled in the art to which it pertains, or with which it is most nearly connected, to make and use the same, and shall set forth the best mode contemplated by the inventor of carrying out his invention. 07-31-01 Claims 1-4 and 7 are rejected under 35 U.S.C. 112(a) or 35 U.S.C. 112 (pre-AIA), first paragraph, as failing to comply with the written description requirement. The claim(s) contains subject matter which was not described in the specification in such a way as to reasonably convey to one skilled in the relevant art that the inventor or a joint inventor, or for applications subject to pre-AIA 35 U.S.C. 112, the inventor(s), at the time the application was filed, had possession of the claimed invention. Claim 1 was amended to recite “a biasing member that biases the arm support shaft in the transport direction.” Applicant stated that “Figure 6 shows a biasing member 58 which is an example of the recited biasing member. The specification states that the biasing member 58 biases the arm section 56 along the transport direction F by the restoring force of the biasing member 58 (see e.g., [0050])” on page 9 of 13 the response. The examiner respectfully disagrees that paragraph [0050] provides support for the amended limitation. Paragraph [0050] of Applicant’s specification states “As described above, the arm support shaft pressing member 64 is attached to the device case 10 or another member. In this state, each of the arm sections 56 is biased to approach the arm support shaft pressing member 64 along the transport direction F by the restoring force of the biasing member 58.” While paragraph [0050] provides support for the protrusions 59 of arm sections 56 being biased (pulled) toward the arm support shaft pressing member 64 by the biasing spring 58 (depicted in Figures 5 and 6), paragraph [0050] does not disclose that the biasing spring 58 biases the arm support shaft 62 in the transport direction nor is there any description as to how the biasing spring 58 effects the arm support shaft 62 in applicant’s description. Additionally, from applicant’s figures it appears that biasing the protrusion(s) 59 of the arm section(s) 56 toward shaft pressing member 64 in the transport direction would result in biasing the arm section(s) 56 to rotate/pivot counter-clockwise about the arm support shaft 62. Allowable Subject Matter 12-151-07 AIA 07-97 12-51-07 Claim s 5 and 6 are allowed. Response to Arguments Applicant’s arguments with respect to claims 1-4 and 7 have been considered but are moot because the new ground of rejection does not rely on any reference applied in the prior rejection of record for any teaching or matter specifically challenged in the argument.
