Office Action

§102 §103
DETAILED ACTION Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Information Disclosure Statement The information disclosure statement (IDS) submitted on 03/27/2024, 10/17/2024, and 07/27/2026 was filed. The submission is in compliance with the provisions of 37 CFR 1.97. Accordingly, the information disclosure statement is being considered by the examiner. Claim Rejections - 35 USC § 102 In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA ) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status. The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action: A person shall be entitled to a patent unless – (a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention. (a)(2) the claimed invention was described in a patent issued under section 151, or in an application for patent published or deemed published under section 122(b), in which the patent or application, as the case may be, names another inventor and was effectively filed before the effective filing date of the claimed invention. Claim(s) 1-4, 7-9, 12, 14, 18 is/are rejected under 35 U.S.C. 102(a)(1) as being anticipated by Kwon et al (US20230069409A1; hereafter “Kwon”). Claim Rejections - 35 USC § 103 Claim 19 is rejected under 35 U.S.C. 103 as being unpatentable over Kwon et al (US20230069409A1; hereafter “Kwon”) as applied to claims 1 and 18 above. Regarding claim 19, Kwon teaches all the limitations as described above. The position is taken that the electrochemical device which comprises the polymer electrolyte composition discloses by Kwon would inherently feature the properties and characteristics listed in claim 19. This is because the polymer electrolyte composition disclosed by Kwon anticipates all the structural limitations set forth by claim 1. Therefore, an electrochemical device that comprises the same polymer electrolyte composition would inherently comprise at least one of the characteristics listed in the claim. Where the claimed and prior art products are identical or substantially identical in structure orcomposition, a prima facie case exists that an unexpressed property is inherent. The burden thereforeshifts to the applicant to establish that the substantially identical prior art electrode does not possessthe claimed force relationship. See MPEP §2112, In re Best, 562 F.2d 1252, 1255 n.4, 195 USPQ 430, 433n.4 (CCPA 1977) and In re Spada, 911 F.2d 705, 709, 15 USPQ2d 1655, 1658 (Fed. Cir. 1990). Claim 20 is rejected under 35 U.S.C. 103 as being unpatentable over Cao et al “US11705580 B2; hereafter “Cao” as applied to claim 16 above. Regarding claim 20, Cao teaches all the limitations as described above. The position is taken that the electrochemical device which comprises the electrolyte composition disclosed by Cao would inherently feature the properties and characteristics listed in claim 20. This is because the electrolyte composition disclosed by Cao anticipates all the structural limitations set forth by claim 16. Therefore, an electrochemical device that comprises the same electrolyte composition would inherently comprise at least one of the characteristics listed in the claim. Cir. 1990).
