DETAILED ACTION
Notice of Pre-AIA or AIA Status
The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
Information Disclosure Statement
As required by M.P.E.P. 609(c), the Applicant's submissions of the Information Disclosure Statement is acknowledged by the examiner and the cited references have been considered in the examination of the claims now pending. As required by M.P.E.P. 609 C(2), a copy of the PTOL-1449 initialed and dated by the examiner is attached to the instant office action.
Applicant’s Information Disclosure Statement has been received, entered into the record, and considered. See attached form PTO-1449.
Claims 1-20 are presented for examination.
Specification
The disclosure is objected to because of the following informalities: The Specification has recited trademarks, such as Wi-Fi (specification, paragraph [0021], for example. The entire specification should be reviewed for trademarks and corrected.
The use of the term “Wi-Fi”, which is a trade name or a mark used in commerce, has been noted in this application. The term should be accompanied by the generic terminology; furthermore, the term should be capitalized wherever it appears or, where appropriate, include a proper symbol indicating use in commerce such as ™, SM , or ® following the term.
Although the use of trade names and marks used in commerce (i.e., trademarks, service marks, certification marks, and collective marks) are permissible in patent applications, the proprietary nature of the marks should be respected and every effort made to prevent their use in any manner which might adversely affect their validity as commercial marks.
Appropriate correction is required.
Claim Objections
Regarding Claims 11, 13-14, and 16-18, this claim is objected to because the claim(s) recite, "if a time frequency resource.. partially overlaps….". Since the limitation of "demodulation" is recited in the alternative (claim language suggests that the "demodulation" may or may not take place) (for example see claim 11). Any functionality followed by the phrase "if" does not hold patentable weight. Appropriate corrections are required.
Claim Rejections - 35 USC § 112
The following is a quotation of 35 U.S.C. 112(b):
(b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention.
The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph:
The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention.
Claims 10, and 11-14 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention.
Examiner is unclear as to what the Applicant intended by the claimed, “it”. For example, when “it” is determined. What is determined? What is “it”? Is “it” a terminal, or terminal behavior or target information, or what? (see claim 10 for example).
Further correction, explanation and correction is required.
Claim Rejections - 35 USC § 102
In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA ) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status.
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(2) the claimed invention was described in a patent issued under section 151, or in an application for patent published or deemed published under section 122(b), in which the patent or application, as the case may be, names another inventor and was effectively filed before the effective filing date of the claimed invention.
Claims 1 and 19-20 are rejected under 35 U.S.C. 102(a)(2) as being anticipated by D. Li et al., (US Patent Publication No. 2023/0049043 A1 and Li hereinafter) .
The applied reference has a common assignee with the instant application. Based upon the earlier effectively filed date of the reference, it constitutes prior art under 35 U.S.C. 102(a)(2). This rejection under 35 U.S.C. 102(a)(2) might be overcome by: (1) a showing under 37 CFR 1.130(a) that the subject matter disclosed in the reference was obtained directly or indirectly from the inventor or a joint inventor of this application and is thus not prior art in accordance with 35 U.S.C. 102(b)(2)(A); (2) a showing under 37 CFR 1.130(b) of a prior public disclosure under 35 U.S.C. 102(b)(2)(B) if the same invention is not being claimed; or (3) a statement pursuant to 35 U.S.C. 102(b)(2)(C) establishing that, not later than the effective filing date of the claimed invention, the subject matter disclosed in the reference and the claimed invention were either owned by the same person or subject to an obligation of assignment to the same person or subject to a joint research agreement.
Regarding Claims 1 and 19-20, Li teaches a behavior (i.e., a target moment, a behavior indicated by the first DCI, where the target moment is: a start moment of the i.sup.th time domain resource, where the terminal completes receiving of the first DCI in the (i−1).sup.th time domain resource, and is a positive integer) determining Para [0064-0065] and (i.e., terminal completes receiving of the first DCI in the second OFDM symbol in the third slot, and completes decoding of the first DCI in the third OFDM symbol in the third slot, the terminal may execute, at a start moment of the fourth OFDM symbol in the third slot, the behavior indicated by the first DCI) Para [0077] method, comprising: obtaining, by a terminal, target information (i.e., indicating a power saving mode, a terminal, and a network side device are provided. The method includes: receiving first Downlink Control Information (DCI), where the first DCI is DCI that is not used for scheduling data, and the first DCI is used to indicate a first cell of the terminal to switch to or activate a target power saving mode) (Abstract) Para [0008], wherein the target information is associated with a plurality of candidate resources for physical downlink control channel (PDCCH) (i.e., an uplink component carrier with a same active time, a downlink component carrier with a same active time, a time interval between a PDCCH and a PDSCH scheduled by the PDCCH, a time interval between a PDCCH and a HARQ-ACK that are of the first DCI, a time interval between a PDCCH and a Physical Uplink Shared CHannel (PUSCH) scheduled by the PDCCH, a PDSCH processing dela ) Para [0101] repetition transmission (i.e., a search space set group, a search space, a PDCCH monitoring cycle, a PDCCH monitoring offset, PDCCH monitoring duration, a BWP bandwidth, a maximum uplink transmission rate, a maximum downlink transmission rate, a discontinuous reception DRX cycle, a number of Channel State Information (CSI) reports that are simultaneously processed by the terminal, a number of beam management reports that are simultaneously processed by the terminal, a number of measurement resources that are simultaneously received or processed by the terminal, a delay related to a CSI report, and a delay related to a beam management report) Para [0101] a search space set group, a search space, a PDCCH monitoring cycle, a PDCCH monitoring offset, PDCCH monitoring duration, a BWP bandwidth, a maximum uplink transmission rate, a maximum downlink transmission rate; and determining, by the terminal (i.e., a search space set group, a search space, a PDCCH monitoring cycle, a PDCCH monitoring offset, PDCCH monitoring duration, a BWP bandwidth, a maximum uplink transmission rate, a maximum downlink transmission rate, a discontinuous reception DRX cycle, a number of Channel State Information (CSI) reports that are simultaneously processed by the terminal, a number of beam management reports that are simultaneously processed by the terminal, a number of measurement resources that are simultaneously received or processed by the terminal, a delay related to a CSI report, and a delay related to a beam management report) [0101], a terminal behavior based on the target information (i.e., executing the behavior indicated by the first DCI, the terminal may switch each cell in the first cell to the target power saving mode, or activate the target power saving mode in each cell in the first cell) Para [0162].
Allowable Subject Matter
The prior art made of record and not relied upon is considered pertinent to applicant’s disclosure [see USPTO Notice of References Cited Form 892]:
Claims 2-18 are objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims.
Claims 2-18 would be allowable if rewritten and/or amending to remedy the 101 rejections presented in this office action.
The following is an examiner's statement of reasons for allowance:
D. Li et al., (US Patent Publication No. 2023/0049043 A1) relates to indicating a power saving mode, a terminal, and a network side device are provided. The first Downlink Control Information (DCI), where the first DCI is DCI that is not used for scheduling data, and the first DCI is used to indicate a first cell of the terminal to switch to or activate a target power saving mode.
However, Li fails to show “wherein the target information comprises downlink control information (DCI) carrying a minimum scheduling slot offset indicator, and the DCI is transmitted on the plurality of candidate resources; and the determining, by the terminal, a terminal behavior based on the target information comprises: determining, by the terminal, a scheduling slot delay value of the terminal based on whether a reference PDCCH candidate resource is within first n orthogonal frequency division multiplexing (OFDM) symbols of a current slot, wherein n is a positive integer, wherein the reference PDCCH candidate resource is a latest PDCCH candidate resource among the plurality of candidate resources”; “DCI carrying a minimum scheduling slot offset indicator, and the DCI is transmitted on the plurality of candidate resources; and the determining, by the terminal, a terminal behavior based on the target information comprises: triggering, by the terminal based on the target information, the terminal to determine a scheduling slot delay value based on whether a reference PDCCH candidate resource is within first n orthogonal frequency division multiplexing (OFDM) symbols of a current slot, wherein n is a positive integer, wherein the reference PDCCH candidate resource is a latest PDCCH candidate resource among the plurality of candidate resources”; search space switching function, search spaces corresponding to the plurality of candidate resources respectively have a same search space group index”; “first PDCCH and a second PDCCH, wherein the first PDCCH carries bandwidth part (BWP) switching information, the second PDCCH carries channel state information (CSI) trigger information, and an activated BWP in which the second PDCCH is located and an activated BWP in which the terminal receives a channel state information-reference signal (CSI-RS) with non-zero power triggered by the second PDCCH are different BWPs”; “determined, based on the target information, that a fourth PDCCH candidate resource among the plurality of candidate resources overlaps, in time, with a radio frequency switching time of the terminal, or with a time of sending a sounding reference signal (SRS) on another carrier frequency, skipping monitoring, by the terminal, the fourth PDCCH candidate resource, and determining, by the terminal, that a PDCCH configured with detection is repetition transmission”; “based on the target information, that a fifth PDCCH candidate resource among the plurality of candidate resources meets a preset condition, skipping monitoring, by the terminal, the fifth PDCCH candidate resource; and if a time-frequency resource of the fifth PDCCH candidate resource partially overlaps with a time-frequency resource of a PDSCH scheduled in the PDCCH repetition transmission, the terminal demodulates the PDSCH based on at least one of the following: the terminal considers that an overlapping resource is not used for carrying the PDSCH, and performs rate matching on the overlapping resource; the terminal considers that an overlapping resource is used for carrying the PDSCH, and does not perform rate matching on the overlapping resource; if the preset condition is configured through radio resource control (RRC), the terminal considers that an overlapping resource is used for carrying the physical downlink shared channel (PDSCH), and does not perform rate matching on the overlapping resource; if the preset condition is configured through DCI, the terminal considers that an overlapping resource is not used for carrying the PDSCH, and performs rate matching on the overlapping resource; base on a configuration or an indication of a network side device, the terminal considers that an overlapping resource is not used for carrying the PDSCH, and performs rate matching on the overlapping resource”; “determining the terminal behavior when it is determined, based on the target information, that on a monitoring occasion, initial control channel element (CCE) indexes of a PDCCH candidate resource at a first aggregation level and a PDCCH candidate resource at a second aggregation level are the same, a control resource set (CORESET) associated with the PDCCH candidate resource at the first aggregation level and the PDCCH candidate resource at second aggregation level is configured as a non-interleaving function, and the CORESET is configured with m OFDM symbols, wherein m is a positive integer, and the second aggregation level is higher than the first aggregation level”; “case that the terminal does not support a capability of independently monitoring a PDCCH candidate resource, a PDCCH for non-repetition transmission is sent on a sixth PDCCH candidate resource, and the sixth PDCCH candidate resource comes from a search space with a minimum identifier (ID) among at least two associated search spaces for PDCCH repetition transmission”; “L1 candidate resources among the plurality of candidate resources have time overlap, the L1 candidate resources are associated with K CORESETs, and the K CORESETs are associated with different pieces of quasi co-location (QCL)-typeD information; and if the terminal receives a PDCCH on a current symbol and receives a CSI-RS resource on the current symbol, and a CSI-RS set associated with the CSI-RS resource is configured to enable and close a repetition sending parameter, then the QCL-typeD information of the CSI-RS is the same as QCL-typeD information of a target reference CORESET in the K CORESETs, wherein the current symbol is a symbol in the time overlap, and the L1 candidate resources comprise at least two candidate resources carrying the same DCI, or the L1 candidate resources comprise at least two candidate resources carrying different pieces of DCI; and L1 is an integer greater than 1, K is an integer greater than 1, and L1 is greater than or equal to K”; and “target PDCCH resource has time overlap with L2 candidate resources among the plurality of candidate resources, the target PDCCH resource and the L2 candidate resources are associated with K CORESETs, and the K CORESETs are associated with different pieces of QCL-typeD information; and if the terminal receives a PDCCH on a current symbol and receives a CSI-RS resource on the current symbol, and a CSI-RS set associated with the CSI-RS resource is configured to enable and close a repetition sending parameter, then the QCL-typeD information of the CSI-RS is the same as QCL-typeD information of a target reference CORESET in the K CORESETs, wherein the target PDCCH resource is a candidate resource that is not used for PDCCH repetition transmission, the current symbol is a symbol in the time overlap, and at least one candidate resource of the target PDCCH resource or the L2 candidate resources carries same DCI, or at least one candidate resource of the target PDCCH resource or the L2 candidate resources carries different pieces of DCI; and L2 is a positive integer, and K is an integer greater than 1”.
