Claim Rejections - 35 USC § 112
The following is a quotation of 35 U.S.C. 112(b):
(b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention.
The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph:
The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention.
Claims 8, 10, and 11 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention.
Re: claim 8, the limitation “the light shielding member” lacks sufficient antecedent basis.
Re: claim 10, the limitations “the holder pedestal side” and “the fixing member side” lack sufficient antecedent basis.
Re: claim 11, because it depends upon claim 10, it is likewise rejected.
Allowable Subject Matter
Claims 8 and 10 would be allowable if rewritten to overcome the rejection(s) under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), 2nd paragraph, set forth in this Office action and to include all of the limitations of the base claim and any intervening claims.
Claims 1-7, 9, and 11-12 are allowed.
The following is an examiner’s statement of reasons for allowance:
Regarding independent claims 1 and 13, prior art reference Kamakura (US 20210063757), now made of record, discloses an image forming element 80 (Fig. 1; para. 28 discloses display element); a holder 100 (Figs. 1, 3) including a supporting member 105a, 105b (Figs. 1, 3) supporting the image forming element (support disclosed in Figs. 1, 4), and a fixing member 50, 10a, 10b (Fig. 3) coupled to the supporting member (coupling disclosed in Figs. 3, 4); an optical member 30 on which image light from the image forming element 80 is incident (incident disclosed in Figs. 4, 6); and a case 72, 75 configured to house the optical member 30 and hold the image forming element 80 therein via the holder 100 (housing & holding disclosed in Fig. 6), wherein the holder 100 includes a transparent portion (para. 24 discloses that element 100C is see-through), and an adhesive material CC that is interposed between fixing member 50 and fixing member 10a, 10b (Fig. 8).
However, Kamakura does not explicitly disclose that the fixing member is fixed to an outside of the case by the adhesive material and that the adhesive material is interposed between the transparent portion and the case.
Re: claims 2-7, 9, and 11-12 are allowed by virtue of their dependence on claim 1.
