DETAILED ACTION Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Priority Receipt is acknowledged of certified copies of papers required by 37 CFR 1.55. Information Disclosure Statement The information disclosure statement (IDS) filed 03/29/2024 has been considered by the examiner. Claim Rejections - 35 USC § 102 In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA ) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status. The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action: (a)(2) the claimed invention was described in a patent issued under section 151, or in an application for patent published or deemed published under section 122(b), in which the patent or application, as the case may be, names another inventor and was effectively filed before the effective filing date of the claimed invention. Claim 1-6 are rejected under 35 U.S.C 102 (a)(2) as being anticipated by Sugii et al. (US 2024/0339727 A1). Regarding claim 1, Sugii teaches a rechargeable battery, comprising: an electrode body formed by rolling a stack of a positive electrode sheet and a negative electrode sheet with a separator arranged in between (abstract), wherein: the positive electrode sheet and the negative electrode sheet each include an electrode mixture layer formed on a substrate that serves as a current collector (paragraphs 20 and 25). With further regard to claim 1 and with regard to claim 2 and 3, Sugii teaches a positive mixture layer 0.034 mm to 0.050 mm thick (paragraph 21) With further regard to claim 1 and with regard to claim 4 and 5, Sugii teaches a negative mixture layer 0.060 mm to 0.080 mm thick (paragraph 26) With further regard to claim 1 and 2 and with regard to claim 6, Sugii teaches a positive mixture layer made of carbon nanotubes (paragraph 23). With further regard to claim 1, 2 and 4, Sugii teaches a combination of ethylene carbonate, ethyl methyl carbonate and dimethyl carbonate in the electrolyte solution. (paragraph 15) The examiner notes that Sugii doesn’t specifically teach the fluidity index value of the electrolyte solution, however, the battery of Sugii contains the features of the electrode and electrolyte solution described in the claims and specifications. Therefore, the examiner finds that a prima facie case of anticipation for the fluidity index value of the negative and positive mixture layers and the difference between the two values is established.
