Notice of Pre-AIA or AIA Status
The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
Priority
Acknowledgment is made of applicant's claim for foreign priority based on an application filed in India on 04/01/2023. It is noted, however, that applicant has not filed a certified copy of the IN 202321025074 application as required by 37 CFR 1.55.
Drawings
The subject matter of this application admits of illustration by a drawing to facilitate understanding of the invention. Applicant is required to furnish a drawing under 37 CFR 1.81(c). No new matter may be introduced in the required drawing. Each drawing sheet submitted after the filing date of an application must be labeled in the top margin as either “Replacement Sheet” or “New Sheet” pursuant to 37 CFR 1.121(d).
Claim Rejections - 35 USC § 112
The following is a quotation of 35 U.S.C. 112(b):
(b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention.
The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph:
The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention.
Claim 1 is rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention.
Regarding claim 1, the phrases "acts as" or “function as” renders the claim indefinite because it is unclear whether the limitations following the phrase are part of the claimed invention. See MPEP § 2173.05(d).
Claim Rejections - 35 USC § 102
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention.
Claim(s) 1 is/are rejected under 35 U.S.C. 102(a)(1) as being anticipated by Garcia et al. (US Patent No. 5,850,948).
Re: Claim 1, Garcia discloses the claimed invention including a pump dispenser for dispensing a liquid from a container comprising: an inlet pipe (36) fluidly connected to a pumping sub-assembly (20), the pumping sub-assembly including a housing (24), a piston (60), and a return mechanism (102) in the form of a spring, a cap portion (56) displaceable to function as an actuator to displace a pusher (54) which acts as a canal (78, 80) to transport the desired fluid, a valve ball (32) placed on a seat and secured within a cage (42) to limit displacement of the ball with respect to the seat (Depicted in Fig. 1).
Conclusion
The prior art made of record and not relied upon is considered pertinent to applicant's disclosure. References cited in the PTO-892 are providing showing additional examples of pumps with springs and ball valves.
