Claim Rejections - 35 USC § 102
In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status.
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale or otherwise available to the public before the effective filing date of the claimed invention.
Claim 1 is rejected under 35 U.S.C. 102(a)(1) as being anticipated by MINAMISAWA et al. (US 20190018259 A1, hereinafter “MINAMISAWA”).
Regarding claim 1, MINAMISAWA teaches an optical element driving mechanism (Figs. 1-5, [0037]: optical unit 1 with driving mechanism 6), comprising:
a first movable portion used for connecting a first optical module having an optical axis (Figs. 5-6, [0044]-[0045]: Movable Member 3 includes: the imaging module 2; a rotation seat 25 (i.e., a rotation member) that supports the imaging module 2 from a -Z direction side);
a fixed portion, wherein the first movable portion is movable relative to the fixed portion (Figs. 5, [0040]-[0042]: Fixation Member 5 that supports the movable member 3 from an outer circumferential side via a swing supporting mechanism 4);
and a first driving assembly used for driving the first movable portion to move relative to the fixed portion (Figs. 7-8, [0050]-[0052]: rotation seat 25 includes: a seat main body 41 that is in a plate shape perpendicular to the axis L; and a shaft part 42 that protrudes from a center of the seat main body 41 in the −Z direction).
Allowable Subject Matter
Claims 2-20 are objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims.
