The disclosure is objected to because of the following informalities:
In paragraph [0007], “lead-telluride-oxide halides” should be “lead-telluride-oxide- halides” or “lead telluride oxide halides”.
The specification teaches one of the substrate precursors can be cerium nitrate, but there is no teaching in the paragraphs that describe the substrate that it can be a cerium compound.
The specification teaches the halide source for the perovskite and/or the flux can be zinc halide, potassium halide, sodium halide, lithium halide, calcium halide, strontium halide or barium halide. Since the perovskite is not taught as containing any of these listed metals and zinc, potassium, sodium, lithium and strontium are not includes in the metal that can be present in the substrate, it is unclear if these metals are present in the fluorescent material and if not, how they are removed.
Paragraphs [0070] and [0072] state the perovskite nanocrystals are composed of cesium, a halogen, calcium and titanium. The formulas in the rest of the specification teaches the perovskite nanocrystals are composed of cesium, a halogen, and one of lead, tin or copper. The difference in the teachings in paragraphs [0070] and [0072] and the rest of the specification needs to be explained. Appropriate correction is required.
Claim Objections
Claim 2 is objected to because of the following informalities: In this claim, “lead-telluride-oxide halides” should be “lead-telluride-oxide-halides” or “lead telluride oxide halides”. Appropriate correction is required.
Claim Rejections - 35 USC § 112
The following is a quotation of 35 U.S.C. 112(b):
(b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention.
The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph:
The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention.
Claims 2, 3 and 19 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention.
Claim 1 teaches the substrate is BaO, CaO, Pb3(PO4)2, Pb3TeO4X2 or a combination thereof, wherein X is Br, I or Cl. Claim 2 teaches the substrate is one or more of metal oxide, metal fluoride, phosphate and lead telluride oxide halide. Claim 3 teaches the substrate is BaO, CaO, Al2O3, CaF2, BaF2, Pb3(PO4)2, AlPO4, Pb3TeO4X2 or a combination thereof, wherein X is Br, I or Cl. Claims 2 and 3 depend from claim 1. These claims include substrate choices not taught in claim 1 and therefore are indefinite.
Claim 19 teaches the substrate precursor nitrate is cerium nitrate and the substrate precursor hydrogen phosphate is aluminum hydrogen phosphate. The metals of these precursors are not present in the taught substrate of is BaO, CaO, Pb3(PO4)2, Pb3TeO4X2 or a combination thereof, wherein X is Br, I or Cl. Thus the claim is indefinite for including substrate precursor materials which would not produce the claimed substrate. In addition, this claim is indefinite since it does not teach the substrate precursor for lead or iodine.
The following is a quotation of 35 U.S.C. 112(d):
(d) REFERENCE IN DEPENDENT FORMS.—Subject to subsection (e), a claim in dependent form shall contain a reference to a claim previously set forth and then specify a further limitation of the subject matter claimed. A claim in dependent form shall be construed to incorporate by reference all the limitations of the claim to which it refers.
The following is a quotation of pre-AIA 35 U.S.C. 112, fourth paragraph:
Subject to the following paragraph [i.e., the fifth paragraph of pre-AIA 35 U.S.C. 112], a claim in dependent form shall contain a reference to a claim previously set forth and then specify a further limitation of the subject matter claimed. A claim in dependent form shall be construed to incorporate by reference all the limitations of the claim to which it refers.
Claims 2 and 3 are rejected under 35 U.S.C. 112(d) or pre-AIA 35 U.S.C. 112, 4th paragraph, as being of improper dependent form for failing to further limit the subject matter of the claim upon which it depends, or for failing to include all the limitations of the claim upon which it depends.
Claim 1 teaches the substrate is BaO, CaO, Pb3(PO4)2, Pb3TeO4X2 or a combination thereof, wherein X is Br, I or Cl. Claim 2 teaches the substrate is one or more of metal oxide, metal fluoride, phosphate and lead telluride oxide halide. Claim 3 teaches the substrate is BaO, CaO, Al2O3, CaF2, BaF2, Pb3(PO4)2, AlPO4, Pb3TeO4X2 or a combination thereof, wherein X is Br, I or Cl. Claims 2 and 3 depend from claim 1. These claims include substrate choices not taught in claim 1 and thus the substrate choices in claims 2 and 3 are broader in scope than that in claim 1. This means claims 2 and 3 do not further limit the subject matter of claim 1.
Allowable Subject Matter
Claims 1, 4-7, 9-11, 13, 15-17 and 20 are allowed.
Claim 19 would be allowable if rewritten to overcome the rejection(s) under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), 2nd paragraph, set forth in this Office action and to include all of the limitations of the base claim and any intervening claims.
There is no teaching or suggestion in the cited art of record of a perovskite nanocrystal fluorescent material comprising a micro- or meso-porous template, a substrate arranged on an inner surface of the template and perovksite nanocrystals within the pores of the template; wherein a lattice of the perovskite nanocrystals stacks, or contacts, with a lattice of the substrate to form a passivation interface and the substrate is BaO, CaO, Pb3(PO4)2, Pb3TeO4X2 or a combination thereof, wherein X is Br, I or Cl.
CN 106701070, and U.S. patent application publications 2017/0153382, 2021/0292642 and 2024/003194 are cited as of interest since they teaches mesoporous molecular sieves having perovksite nanocrystals within the pores of the sieves. There is no teaching or suggestion to line the taught pores with BaO, CaO, Pb3(PO4)2, Pb3TeO4X2 or a combination thereof, wherein X is Br, I or Cl.
